88 SENATE JOINT RESOLUTION
99 proposing a constitutional amendment providing that the holdover
1010 provision of the Texas Constitution does not apply to a member of
1111 the Texas Transportation Commission.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 17, Article XVI, Texas Constitution, is
1414 amended to read as follows:
1515 Sec. 17. (a) All officers within this State, other than a
1616 member of the Texas Transportation Commission whose term has
1717 expired, shall continue to perform the duties of their offices
1818 until their successors shall be duly qualified.
1919 (b) A member of the Texas Transportation Commission whose
2020 term has expired may not continue to perform the duties of a member
2121 of the commission, and a vacancy is created in the member's
2222 position.
2323 SECTION 2. This proposed constitutional amendment shall be
2424 submitted to the voters at an election to be held November 3, 2009.
2525 The ballot shall be printed to permit voting for or against the
2626 proposition: "The constitutional amendment providing that the
2727 holdover provision of the Texas Constitution does not apply to a
2828 member of the Texas Transportation Commission."
