12 | 12 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 17, Article XVI, Texas Constitution, is |

14 | 14 | | amended to read as follows: |

15 | 15 | | Sec. 17. (a) All officers within this State, other than a |
---|
16 | 16 | | member of the Texas Transportation Commission whose term has |
---|
17 | 17 | | expired, shall continue to perform the duties of their offices |
---|
18 | 18 | | until their successors shall be duly qualified. |
---|
19 | 19 | | (b) A member of the Texas Transportation Commission whose |
---|
20 | 20 | | term has expired may not continue to perform the duties of a member |
---|
21 | 21 | | of the commission, and a vacancy is created in the member's |
---|
22 | 22 | | position. |
---|
23 | 23 | | SECTION 2. This proposed constitutional amendment shall be |

24 | 24 | | submitted to the voters at an election to be held November 3, 2009. |
---|
25 | 25 | | The ballot shall be printed to permit voting for or against the |
---|
26 | 26 | | proposition: "The constitutional amendment providing that the |
---|
27 | 27 | | holdover provision of the Texas Constitution does not apply to a |
---|
28 | 28 | | member of the Texas Transportation Commission." |
