11 SENATE RESOLUTION NO. 1044
22 WHEREAS, The Texas Constitution sets forth a declaration
33 of rights, "That the general, great and essential principles of
44 liberty and free government may be recognized and established";
55 and
66 WHEREAS, Article I, Section 1, of the Texas Constitution
77 declares, "Texas is a free and independent State, subject only to
88 the Constitution of the United States, and the maintenance of our
99 free institutions and the perpetuity of the Union depend upon the
1010 preservation of the right of local self-government, unimpaired
1111 to all the States."; and
1212 WHEREAS, Article I, Section 2, of the Texas Constitution
1313 declares, "All political power is inherent in the people, and all
1414 free governments are founded on their authority, and instituted
1515 for their benefit. The faith of the people of Texas stands
1616 pledged to the preservation of a republican form of government,
1717 and, subject to this limitation only, they have at all times the
1818 inalienable right to alter, reform or abolish their government in
1919 such a manner as they may think expedient."; and
2020 WHEREAS, The Ninth Amendment of the United States
2121 Constitution declares, "The enumeration in the Constitution, of
2222 certain rights, shall not be construed to deny or disparage
2323 others retained by the people."; and
2424 WHEREAS, The Tenth Amendment of the United States
2525 Constitution declares, "The powers not delegated to the United
2626 States by the Constitution, nor prohibited by it to the States,
2727 are reserved to the States respectively, or to the people."; and
2828 WHEREAS, The Declaration of Independence approved by the
2929 Second Continental Congress of the thirteen United States of
3030 America did so eloquently declare, "We hold these truths to be
3131 self-evident, that all men are created equal, that they are
3232 endowed by their Creator with certain inalienable Rights, that
3333 among these are Life, Liberty, and the pursuit of Happiness.";
3434 and
3535 WHEREAS, Those elected by the people at all levels of
3636 government should be responsive to the people and renew their
3737 commitment to defending and upholding the principles inscribed
3838 in the Declaration of Independence of the United States of
3939 America, the United States Constitution, and the Texas
4040 Constitution; and
4141 WHEREAS, The Declaration of Independence of the United
4242 States of America, the United States Constitution, and the Texas
4343 Constitution express in no uncertain terms or ambiguity that we
4444 the people of the United States of America and the State of Texas
4545 are entitled to the rights bestowed by our God for our mutual
4646 benefit by His benevolence; now, therefore, be it
4747 RESOLVED, That the Senate of the State of Texas, 81st
4848 Legislature, hereby pay tribute to and reaffirm the rights
4949 guaranteed to the people of the United States as expressed by the
5050 Declaration of Independence of the United States of America, the
5151 United States Constitution, and the Texas Constitution; and, be
5252 it further
5353 RESOLVED, That the Senate hereby honor those who have
5454 exercised their rights to free speech, free assembly, and free
5555 expression in support of our constitutional rights and
5656 individual liberties.
