1	1	SENATE RESOLUTION NO. 1044
2	2	WHEREAS, The Texas Constitution sets forth a declaration
3	3	of rights, "That the general, great and essential principles of
4	4	liberty and free government may be recognized and established";
5	5	and
6	6	WHEREAS, Article I, Section 1, of the Texas Constitution
7	7	declares, "Texas is a free and independent State, subject only to
8	8	the Constitution of the United States, and the maintenance of our
9	9	free institutions and the perpetuity of the Union depend upon the
10	10	preservation of the right of local self-government, unimpaired
11	11	to all the States."; and
12	12	WHEREAS, Article I, Section 2, of the Texas Constitution
13	13	declares, "All political power is inherent in the people, and all
14	14	free governments are founded on their authority, and instituted
15	15	for their benefit. The faith of the people of Texas stands
16	16	pledged to the preservation of a republican form of government,
17	17	and, subject to this limitation only, they have at all times the
18	18	inalienable right to alter, reform or abolish their government in
19	19	such a manner as they may think expedient."; and
20	20	WHEREAS, The Ninth Amendment of the United States
21	21	Constitution declares, "The enumeration in the Constitution, of
22	22	certain rights, shall not be construed to deny or disparage
23	23	others retained by the people."; and
24	24	WHEREAS, The Tenth Amendment of the United States
25	25	Constitution declares, "The powers not delegated to the United
26	26	States by the Constitution, nor prohibited by it to the States,
27	27	are reserved to the States respectively, or to the people."; and
28	28	WHEREAS, The Declaration of Independence approved by the
29	29	Second Continental Congress of the thirteen United States of
30	30	America did so eloquently declare, "We hold these truths to be
31	31	self-evident, that all men are created equal, that they are
32	32	endowed by their Creator with certain inalienable Rights, that
33	33	among these are Life, Liberty, and the pursuit of Happiness.";
34	34	and
35	35	WHEREAS, Those elected by the people at all levels of
36	36	government should be responsive to the people and renew their
37	37	commitment to defending and upholding the principles inscribed
38	38	in the Declaration of Independence of the United States of
39	39	America, the United States Constitution, and the Texas
40	40	Constitution; and
41	41	WHEREAS, The Declaration of Independence of the United
42	42	States of America, the United States Constitution, and the Texas
43	43	Constitution express in no uncertain terms or ambiguity that we
44	44	the people of the United States of America and the State of Texas
45	45	are entitled to the rights bestowed by our God for our mutual
46	46	benefit by His benevolence; now, therefore, be it
47	47	RESOLVED, That the Senate of the State of Texas, 81st
48	48	Legislature, hereby pay tribute to and reaffirm the rights
49	49	guaranteed to the people of the United States as expressed by the
50	50	Declaration of Independence of the United States of America, the
51	51	United States Constitution, and the Texas Constitution; and, be
52	52	it further
53	53	RESOLVED, That the Senate hereby honor those who have
54	54	exercised their rights to free speech, free assembly, and free
55	55	expression in support of our constitutional rights and
56	56	individual liberties.
