44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 House Bill No. 51 (measures to enhance and maintain the quality
1010 of state universities, including funding and incentives to
1111 support emerging public research universities, to the abolition
1212 of the higher education fund, to the institutional groupings
1313 under the Texas Higher Education Coordinating Board's
1414 accountability system, to the independent status of Lamar
1515 Institute of Technology, to research conducted by public
1616 universities and other state entities, and to the authorization
1717 of revenue bonds for certain institutions of higher education) to
1818 consider and take action on the following matter:
1919 Senate Rule 12.03(4) is suspended to permit the committee
2020 to add the following new SECTIONS to the bill:
2121 SECTION 2. Subchapter B, Chapter 55, Education Code, is
2222 amended by adding Sections 55.1771 and 55.17721 to read as
2323 follows:
2424 Sec. 55.1771. TEXAS A&M UNIVERSITY AT GALVESTON. (a) In
2525 addition to the other authority granted by this subchapter and
2626 subject to the other provisions of this section, the board of
2727 regents of The Texas A&M University System may acquire, purchase,
2828 construct, improve, renovate, enlarge, or equip property,
2929 buildings, structures, facilities, roads, or related
3030 infrastructure for Texas A&M University at Galveston for an
3131 erosion control breakwater, a dock, or any other related purpose
3232 reasonably necessary to assist the institution to recover from
3333 any damage or other impact caused by Hurricane Ike, to be
3434 financed by the issuance of bonds in accordance with this
3535 subchapter, including bonds issued in accordance with a
3636 systemwide revenue financing program and secured as provided by
3737 that program, in an aggregate principal amount not to exceed $5
3838 million.
3939 (b) The board of regents may pledge irrevocably to the
4040 payment of the bonds authorized by this section all or any part of
4141 the revenue funds of an institution, branch, or entity of The
4242 Texas A&M University System, including student tuition charges.
4343 The amount of a pledge made under this subsection may not be
4444 reduced or abrogated while the bonds for which the pledge is
4545 made, or bonds issued to refund those bonds, are outstanding.
4646 (c) If sufficient funds are not available to the board of
4747 regents to meet its obligations under this section, the board may
4848 transfer funds among institutions, branches, and entities of The
4949 Texas A&M University System to ensure the most equitable and
5050 efficient allocation of available resources for each
5151 institution, branch, or entity to carry out its duties and
5252 purposes.
5353 Sec. 55.17721. THE UNIVERSITY OF TEXAS MEDICAL BRANCH AT
5454 GALVESTON. (a) In addition to the other authority granted by
5555 this subchapter and subject to the other provisions of this
5656 section, the board of regents of The University of Texas System
5757 may acquire, purchase, construct, improve, renovate, enlarge, or
5858 equip property, buildings, structures, facilities, roads, or
5959 related infrastructure for The University of Texas Medical
6060 Branch at Galveston for any purpose reasonably necessary to
6161 assist the institution to recover from any damage or other impact
6262 caused by Hurricane Ike, to be financed by the issuance of bonds
6363 in accordance with this subchapter, including bonds issued in
6464 accordance with a systemwide revenue financing program and
6565 secured as provided by that program, in an aggregate principal
6666 amount not to exceed $150 million.
6767 (b) The board may pledge irrevocably to the payment of
6868 the bonds authorized by this section all or any part of the
6969 revenue funds of an institution, branch, or entity of The
7070 University of Texas System, including student tuition charges.
7171 The amount of a pledge made under this subsection may not be
7272 reduced or abrogated while the bonds for which the pledge is
7373 made, or bonds issued to refund those bonds, are outstanding.
7474 (c) If sufficient funds are not available to the board to
7575 meet its obligations under this section, the board may transfer
7676 funds among institutions, branches, and entities of The
7777 University of Texas System to ensure the most equitable and
7878 efficient allocation of available resources for each
7979 institution, branch, or entity to carry out its duties and
8080 purposes.
8181 (d) Any transfer of funds to the board pursuant to an
8282 appropriation of state funds to the board or The University of
8383 Texas Medical Branch at Galveston for the purpose of reimbursing
8484 the board for all or part of the debt service on bonds issued
8585 under this section is subject to the prior approval of the
8686 Legislative Budget Board. In determining whether to approve a
8787 transfer of state funds for that purpose, the Legislative Budget
8888 Board shall consider:
8989 (1) whether the commissioners court of the county in
9090 which the medical branch is located has entered into an agreement
9191 with the board under which the county agrees to reimburse the
9292 board for all or part of any otherwise unreimbursed costs
9393 incurred by the medical branch to provide health care services to
9494 individuals who are residents of the county and whose net family
9595 income is not more than 100 percent of the federal poverty level;
9696 or
9797 (2) whether the county in which the medical branch
9898 is located or a hospital district that includes that county
9999 imposes an ad valorem tax for health care purposes.
100100 (e) For purposes of Subsection (d), the county of
101101 residence of an individual is determined in the same manner as
102102 provided by Chapter 61, Health and Safety Code.
103103 SECTION 3. Section 61.0572(e), Education Code, is
104104 amended to read as follows:
105105 (e) Approval of the board is not required to acquire real
106106 property that is financed by bonds issued under Section
107107 55.17(e)(3) or (4), 55.1713-55.1718, 55.1721-55.1728,
108108 55.1735(a)(1), 55.174, 55.1742, 55.1743, 55.1744,
109109 55.1751-55.17592, [or] 55.1768, 55.1771, or 55.17721, except
110110 that the board shall review all real property to be financed by
111111 bonds issued under those sections to determine whether the
112112 property meets the standards adopted by the board for cost,
113113 efficiency, and space use. If the property does not meet those
114114 standards, the board shall notify the governor, the lieutenant
115115 governor, the speaker of the house of representatives, and the
116116 Legislative Budget Board.
117117 SECTION 4. Section 61.058(b), Education Code, is amended
118118 to read as follows:
119119 (b) This section does not apply to construction, repair,
120120 or rehabilitation financed by bonds issued under Section
121121 55.17(e)(3) or (4), 55.1713-55.1718, 55.1721-55.1728, 55.174,
122122 55.1742, 55.1743, 55.1744, 55.1751-55.17592, [or] 55.1768,
123123 55.1771, or 55.17721, except that the board shall review all
124124 construction, repair, or rehabilitation to be financed by bonds
125125 issued under those sections to determine whether the
126126 construction, rehabilitation, or repair meets the standards
127127 adopted by board rule for cost, efficiency, and space use. If the
128128 construction, rehabilitation, or repair does not meet those
129129 standards, the board shall notify the governor, the lieutenant
130130 governor, the speaker of the house of representatives, and the
131131 Legislative Budget Board.
132132 Explanation: This addition is necessary to enable the
133133 governing boards of Texas A&M University at Galveston and The
134134 University of Texas Medical Branch at Galveston to issue tuition
135135 revenue bonds to finance capital improvements at those
136136 institutions that are reasonably necessary to assist the
137137 institutions in recovering from any damage or other impact caused
138138 by Hurricane Ike.
