| 6 | 6 | | Legislature, Regular Session, 2009, That Senate Rule 12.03 be |

| 7 | 7 | | suspended in part as provided by Senate Rule 12.08 to enable the |

| 8 | 8 | | conference committee appointed to resolve the differences on |

| 9 | 9 | | Senate Bill No. 2513 (name and confirmation of, and certain fees |
|---|
| 10 | 10 | | imposed by, the McLennan County Groundwater Conservation |
|---|
| 11 | 11 | | District and the authority to create certain adjacent |
|---|
| 12 | 12 | | groundwater conservation districts) to consider and take action |
|---|
| 13 | 13 | | on the following matter: |
|---|
| 14 | 14 | | (1) Senate Rules 12.03(3) and (4) are suspended to permit |
|---|
| 15 | 15 | | the conference committee to add the following: |
|---|
| 16 | 16 | | SECTION 3. Section 8821.002, Special District Local Laws |
|---|
| 17 | 17 | | Code, is amended to read as follows: |
|---|
| 18 | 18 | | Sec. 8821.002. NATURE OF DISTRICT. The district is a |
|---|
| 19 | 19 | | groundwater conservation district in McLennan County created |
|---|
| 20 | 20 | | under and essential to accomplish the purposes of Section 59, |
|---|
| 21 | 21 | | Article XVI, Texas Constitution. The district is located in a |
|---|
| 22 | 22 | | priority groundwater management area designated by the Texas |
|---|
| 23 | 23 | | Commission on Environmental Quality pursuant to Section 35.008, |
|---|
| 24 | 24 | | Water Code. |
|---|
| 25 | 25 | | Explanation: The addition of the SECTION to the bill is |
|---|
| 26 | 26 | | necessary to recognize that the Southern Trinity Groundwater |
|---|
| 27 | 27 | | Conservation District is in a priority groundwater management |
|---|
| 28 | 28 | | area designated by the Texas Commission on Environmental |
|---|
| 29 | 29 | | Quality. |

| 30 | 30 | | (2) Senate Rules 12.03(3) and (4) are suspended to permit |
|---|
| 31 | 31 | | the conference committee to add the following: |

| 32 | 32 | | SECTION 8. Notwithstanding Sections 35.012 and 36.0151, |

| 33 | 33 | | Water Code, the Texas Commission on Environmental Quality shall |

| 34 | 34 | | not, before September 1, 2011, create a groundwater conservation |

| 35 | 35 | | district: |

| 36 | 36 | | (1) in the priority groundwater management area in which |
|---|
| 37 | 37 | | the Southern Trinity Groundwater Conservation District is |

| 38 | 38 | | located; or |
|---|
| 39 | 39 | | (2) in a priority groundwater management area that is |
|---|
| 40 | 40 | | adjacent to the priority groundwater management area in which the |
|---|
| 41 | 41 | | Southern Trinity Groundwater Conservation District is located. |

| 42 | 42 | | Explanation: The addition of the SECTION to the bill is |

| 43 | 43 | | necessary to delay until September 11, 2011, the requirement for |
|---|
| 44 | 44 | | the Texas Commission on Environmental Quality to create a |
|---|
| 45 | 45 | | groundwater conservation district in the same priority |
|---|
| 46 | 46 | | groundwater management area in which the Southern Trinity |
|---|
| 47 | 47 | | Groundwater Conservation District is located or in a priority |
