44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill No. 1742 (the regulation of the discharge of firearms
1010 and certain other weapons by certain municipalities) to consider
1111 and take action on the following matters:
1212 (1) Senate Rules 12.03(1), (2), and (3) are suspended to
1313 permit the committee to change text not in disagreement and to
1414 add text in proposed Subdivisions (1) and (2), Subsection (b),
1515 Section 229.003, Local Government Code, so that the subdivisions
1616 read as follows:
1717 (1) a shotgun, air rifle or pistol, BB gun, or bow
1818 and arrow discharged:
1919 (A) on a tract of land of 10 acres or more and:
2020 (i) more than 1,000 feet from:
2121 (a) the property line of a public
2222 tract of land, generally accessible by the public, that is
2323 routinely used for organized sporting or recreational activities
2424 or that has permanent recreational facilities or equipment; and
2525 (b) the property line of a school,
2626 hospital, or commercial day-care facility;
2727 (ii) more than 600 feet from:
2828 (a) the property line of a
2929 residential subdivision; and
3030 (b) the property line of a
3131 multifamily residential complex; and
3232 (iii) more than 150 feet from a residence
3333 or occupied building located on another property; and
3434 (B) in a manner not reasonably expected to
3535 cause a projectile to cross the boundary of the tract;
3636 (2) a center fire or rim fire rifle or pistol of any
3737 caliber discharged:
3838 (A) on a tract of land of 50 acres or more and:
3939 (i) more than 1,000 feet from:
4040 (a) the property line of a public
4141 tract of land, generally accessible by the public, that is
4242 routinely used for organized sporting or recreational activities
4343 or that has permanent recreational facilities or equipment; and
4444 (b) the property line of a school,
4545 hospital, or commercial day-care facility;
4646 (ii) more than 600 feet from:
4747 (a) the property line of a
4848 residential subdivision; and
4949 (b) the property line of a
5050 multifamily residential complex; and
5151 (iii) more than 300 feet from a residence
5252 or occupied building located on another property; and
5353 (B) in a manner not reasonably expected to
5454 cause a projectile to cross the boundary of the tract; or
5555 Explanation: The changes in text are necessary to limit
5656 the areas in which certain municipalities can regulate the
5757 discharge of certain weapons. The additions are necessary to
5858 include the areas around schools, hospitals, and commercial
5959 day-care facilities in the areas in which certain municipalities
6060 can regulate the discharge of certain weapons.
6161 (2) Senate Rule 12.03(2) is suspended to permit the
6262 committee to omit text not in disagreement in proposed Subsection
6363 (c), Section 229.003, Local Government Code, in the house version
6464 of the bill and in proposed Subsection (b), Section 229.002,
6565 Local Government Code, in the senate version of the bill, that
6666 reads as follows:
6767 A municipality may adopt and enforce a regulation
6868 prohibiting or restricting excessive noise from the discharge of
6969 a firearm in the extraterritorial jurisdiction of the
7070 municipality or in an area annexed by the municipality after
7171 September 1, 1981.
7272 Explanation: This omission is necessary so that the Act
7373 does not permit certain municipalities to adopt and enforce a
7474 regulation prohibiting or restricting excessive noise from the
7575 discharge of a firearm in certain areas.
