44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill No. 379, relating to an annual report by the Texas
1010 Fusion Center regarding criminal street gangs and gang-related
1111 crime, to consider and take action on the following matter:
1212 (1) Senate Rule 12.03(1) is suspended to permit the
1313 committee to change text not in disagreement in proposed SECTION
1414 1 of the bill, in added Subsection (e), Section 421.082,
1515 Government Code, and in SECTION 2 of the bill, so that they read
1616 as follows:
1717 (e) The gang section of the center shall annually submit
1818 to the governor and the legislature a report assessing the threat
1919 posed statewide by criminal street gangs. The report must
2020 include identification of:
2121 (1) law enforcement strategies that have been
2222 proven effective in deterring gang-related crime; and
2323 (2) gang involvement in trafficking of persons.
2424 SECTION 2. The gang section of the Texas Fusion Center
2525 shall submit the first annual report required by Subsection (e),
2626 Section 421.082, Government Code, as added by this Act, not later
2727 than September 1, 2010.
2828 Explanation: This change is necessary to require the gang
2929 section of the Texas Fusion Center to produce the report and to
3030 ensure that certain matters are included in the report.
3131 (2) Senate Rule 12.03(1) is suspended to permit the
3232 committee to change text not in disagreement in proposed SECTION
3333 1 of the bill, in added Subsection (f), Section 421.082,
3434 Government Code, so that it reads as follows:
3535 (f) On request, the office of the attorney general, the
3636 Department of Public Safety, the Texas Department of Criminal
3737 Justice, other law enforcement agencies, and juvenile justice
3838 agencies of this state shall provide to the gang section of the
3939 center information relating to criminal street gangs,
4040 gang-related crime, and gang involvement in trafficking of
4141 persons.
4242 Explanation: This change is necessary to require certain
4343 law enforcement agencies to comply with a request from the Texas
4444 Fusion Center to provide information relating to criminal street
4545 gangs, gang-related crime, and gang involvement in trafficking
4646 of persons.
4747 (3) Senate Rule 12.03(2) is suspended to permit the
4848 committee to omit text not in disagreement in proposed SECTION 1
4949 of the bill, by omitting added Subsection (g), Section 421.082,
5050 Government Code.
5151 Explanation: The omission is necessary to remove a
5252 restriction on the information that may be included in the
5353 report.
