5	5	BE IT RESOLVED by the Senate of the State of Texas, 81st
6	6	Legislature, Regular Session, 2009, That Senate Rule 12.03 be
7	7	suspended in part as provided by Senate Rule 12.08 to enable the
8	8	conference committee appointed to resolve the differences on
9	9	Senate Bill No. 379, relating to an annual report by the Texas
10	10	Fusion Center regarding criminal street gangs and gang-related
11	11	crime, to consider and take action on the following matter:
12	12	(1) Senate Rule 12.03(1) is suspended to permit the
13	13	committee to change text not in disagreement in proposed SECTION
14	14	1 of the bill, in added Subsection (e), Section 421.082,
15	15	Government Code, and in SECTION 2 of the bill, so that they read
16	16	as follows:
17	17	(e) The gang section of the center shall annually submit
18	18	to the governor and the legislature a report assessing the threat
19	19	posed statewide by criminal street gangs. The report must
20	20	include identification of:
21	21	(1) law enforcement strategies that have been
22	22	proven effective in deterring gang-related crime; and
23	23	(2) gang involvement in trafficking of persons.
24	24	SECTION 2. The gang section of the Texas Fusion Center
25	25	shall submit the first annual report required by Subsection (e),
26	26	Section 421.082, Government Code, as added by this Act, not later
27	27	than September 1, 2010.
28	28	Explanation: This change is necessary to require the gang
29	29	section of the Texas Fusion Center to produce the report and to
30	30	ensure that certain matters are included in the report.
31	31	(2) Senate Rule 12.03(1) is suspended to permit the
32	32	committee to change text not in disagreement in proposed SECTION
33	33	1 of the bill, in added Subsection (f), Section 421.082,
34	34	Government Code, so that it reads as follows:
35	35	(f) On request, the office of the attorney general, the
36	36	Department of Public Safety, the Texas Department of Criminal
37	37	Justice, other law enforcement agencies, and juvenile justice
38	38	agencies of this state shall provide to the gang section of the
39	39	center information relating to criminal street gangs,
40	40	gang-related crime, and gang involvement in trafficking of
41	41	persons.
42	42	Explanation: This change is necessary to require certain
43	43	law enforcement agencies to comply with a request from the Texas
44	44	Fusion Center to provide information relating to criminal street
45	45	gangs, gang-related crime, and gang involvement in trafficking
46	46	of persons.
47	47	(3) Senate Rule 12.03(2) is suspended to permit the
48	48	committee to omit text not in disagreement in proposed SECTION 1
49	49	of the bill, by omitting added Subsection (g), Section 421.082,
50	50	Government Code.
51	51	Explanation: The omission is necessary to remove a
52	52	restriction on the information that may be included in the
53	53	report.
