44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 House Bill No. 2682 (the authority of municipalities to alter
1010 speed limits) to consider and take action on the following
1111 matter:
1212 Senate Rule 12.03(1), is suspended to permit the committee
1313 to change text not in disagreement in SECTION 1 of the bill, in
1414 Subsections (b-1) and (b-2), Section 545.356, Transportation
1515 Code, to read as follows:
1616 (b-1) The [Except as provided by Subsection (b-2), the]
1717 governing body of a municipality, for a highway or a part of a
1818 highway in [an urban district in] the municipality that is not an
1919 officially designated or marked highway or road of the state
2020 highway system, [is 35 feet or less in width, and along which
2121 vehicular parking is not prohibited on one or both sides of the
2222 highway,] may declare a lower speed limit of not less than 25
2323 miles per hour, if the governing body determines that the prima
2424 facie speed limit on the highway is unreasonable or unsafe.
2525 (b-2) Subsection (b-1) applies only [does not apply] to a
2626 two-lane, undivided highway or part of a highway [that has four
2727 or more lanes used for vehicular travel].
2828 Explanation: This change is necessary to clarify the type
2929 of highway to which a municipality's authority to alter the speed
3030 limit applies.
