44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That the Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 House Bill No. 1506 (the imposition of conditions on certain
1010 defendants charged with an offense involving family violence) to
1111 consider and take action on the following matter:
1212 Senate Rules 12.03(2), (3), and (4) are suspended to
1313 permit the committee to omit Subsection (h), Article 17.49, Code
1414 of Criminal Procedure, as added by the senate and house versions
1515 of the bill, and to add new Subsections (h) and (i), Article
1616 17.49, Code of Criminal Procedure, to read as follows:
1717 (h) If the magistrate determines that a defendant is
1818 indigent, the magistrate may, based on a sliding scale
1919 established by local rule, require the defendant to pay costs
2020 under Subsection (b)(2) or (3) in an amount that is less than the
2121 full amount of the costs associated with operating the global
2222 positioning monitoring system in relation to the defendant or
2323 providing the victim with an electronic receptor device.
2424 (i) If an indigent defendant pays to an entity that
2525 operates a global positioning monitoring system the partial
2626 amount ordered by a magistrate under Subsection (h), the entity
2727 shall accept the partial amount as payment in full. The county in
2828 which the magistrate who enters an order under Subsection (h) is
2929 located is not responsible for payment of any costs associated
3030 with operating the global positioning monitoring system in
3131 relation to an indigent defendant.
3232 Explanation: This change is necessary to remove a
3333 provision allowing an indigent defendant to perform community
3434 supervision in lieu of paying certain costs and to add provisions
3535 to allow a magistrate, without obligating the county to pay any
3636 of the costs, to require an indigent defendant to pay less than
3737 the full costs associated with operating a global positioning
3838 monitoring system in relation to the defendant or with providing
3939 an electronic receptor device to the victim of the offense
4040 committed by the defendant.
