44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill 1068 (allowing a governmental body to redact certain
1010 personal information under the public information law without
1111 the necessity of requesting a decision from the attorney general
1212 and allowing information about a public officer or public
1313 employee to be withheld if disclosure would pose a substantial
1414 risk of physical harm) to consider and take action on the
1515 following matter:
1616 Senate Rules 12.03(3) and (4) are suspended to permit the
1717 committee to add SECTION 4 to the bill to read as follows:
1818 SECTION 4. Subchapter C, Chapter 552, Government Code,
1919 is amended by adding Section 552.151 to read as follows:
2020 Sec. 552.151. EXCEPTION: PUBLIC EMPLOYEE OR OFFICER
2121 PERSONAL SAFETY. Information in the custody of a governmental
2222 body that relates to an employee or officer of the governmental
2323 body is excepted from the requirements of Section 552.021 if,
2424 under the specific circumstances pertaining to the employee or
2525 officer, disclosure of the information would subject the
2626 employee or officer to a substantial threat of physical harm.
2727 Explanation: This addition is necessary to amend the
2828 public information law to allow information relating to a public
2929 officer or public employee to be withheld from disclosure if
3030 disclosure would pose a substantial risk of physical harm.
