| 5 | 5 | | BE IT RESOLVED by the Senate of the State of Texas, 81st |
|---|
| 6 | 6 | | Legislature, Regular Session, 2009, That Senate Rule 12.03 be |
|---|
| 7 | 7 | | suspended in part as provided by Senate Rule 12.08 to enable the |
|---|
| 8 | 8 | | conference committee appointed to resolve the differences on |
|---|
| 9 | 9 | | Senate Bill No. 726 (the creation of the Harrison County and |
|---|
| 10 | 10 | | Prairielands Groundwater Conservation Districts, providing |
|---|
| 11 | 11 | | authority to impose a tax and issue bonds and granting a limited |
|---|
| 12 | 12 | | power of eminent domain) to consider and take action on the |
|---|
| 13 | 13 | | following matter: |
|---|
| 14 | 14 | | Senate Rule 12.03(2) is suspended to permit the committee |
|---|
| 15 | 15 | | to omit text not in disagreement in proposed Section 8850.005, |
|---|
| 16 | 16 | | Special District Local Laws Code, in both versions of the bill, |
|---|
| 17 | 17 | | that reads as follows: |
|---|
| 18 | 18 | | Sec. 8850.005. DISTRICT TERRITORY REQUIREMENTS; |
|---|
| 19 | 19 | | DISSOLUTION OF DISTRICT. (a) On September 1, 2013, the district |
|---|
| 20 | 20 | | boundaries must include at least one county adjacent to Harrison |
|---|
| 21 | 21 | | County. |
|---|
| 22 | 22 | | (b) As soon as practicable after September 1, 2013, the |
|---|
| 23 | 23 | | Texas Commission on Environmental Quality shall determine |
|---|
| 24 | 24 | | whether the district complies with Subsection (a). |
|---|
| 25 | 25 | | (c) If the commission determines that the district does |
|---|
| 26 | 26 | | not comply with Subsection (a), the commission shall dissolve the |
|---|
| 27 | 27 | | district in accordance with Sections 36.304, 36.305, 36.307, |
|---|
| 28 | 28 | | 36.308, 36.309, and 36.310, Water Code, regardless of whether the |
|---|
| 29 | 29 | | district meets the criteria for dissolution under Section |
|---|
| 30 | 30 | | 36.304(a), Water Code. |
|---|
| 31 | 31 | | (d) This section expires September 1, 2015. |
|---|
| 32 | 32 | | Explanation: The omission is necessary because this |
|---|
| 33 | 33 | | provision is not essential to the creation, duties, or powers of |
|---|
| 34 | 34 | | the district. |
