| 5 | 5 | | BE IT RESOLVED by the Senate of the State of Texas, 81st |

| 6 | 6 | | Legislature, Regular Session, 2009, That Senate Rule 12.03 be |

| 7 | 7 | | suspended in part as provided by Senate Rule 12.08 to enable the |
|---|
| 8 | 8 | | conference committee appointed to resolve the differences on |
|---|
| 9 | 9 | | House Bill No. 4102 (the disaster contingency fund and relief for |
|---|
| 10 | 10 | | school districts located in a disaster area), to consider and |
|---|
| 11 | 11 | | take action on the following matter: |
|---|
| 12 | 12 | | Senate Rule 12.03(1) is suspended to permit the committee |
|---|
| 13 | 13 | | to change text not in disagreement in SECTION 1 of the bill, in |
|---|
| 14 | 14 | | Subsection (c), Section 418.073, Government Code, to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (c) A state or [agency,] local government[, or other |
|---|
| 17 | 17 | | eligible] entity that participates in disaster preparation or |
|---|
| 18 | 18 | | disaster recovery may request and receive funding from the |
|---|
| 19 | 19 | | disaster contingency fund to pay for[: |
|---|
| 20 | 20 | | [(1) extraordinary] costs incurred by the state or |
|---|
| 21 | 21 | | local government entity in preparing for or recovering from |
|---|
| 22 | 22 | | [implementing preventive measures taken before or during an |
|---|
| 23 | 23 | | emergency; and |
|---|
| 24 | 24 | | [(2) costs incurred in repairing damage suffered |
|---|
| 25 | 25 | | during] a disaster [for which: |
|---|
| 26 | 26 | | [(A) the presiding officer of a municipal or |
|---|
| 27 | 27 | | county government has declared a local state of disaster for |
|---|
| 28 | 28 | | affected areas within the jurisdiction of the municipality or |
|---|
| 29 | 29 | | county; and |
|---|
| 30 | 30 | | [(B) the governor has also declared a state of |
|---|
| 31 | 31 | | disaster for the affected county or counties]. |

| 32 | 32 | | Explanation: This change is necessary to maintain the |
|---|
| 33 | 33 | | ability of a state or local government entity to receive |
|---|
| 34 | 34 | | reimbursement from the disaster contingency fund for costs |
|---|
| 35 | 35 | | incurred by the entity in preparing for disasters. |
