44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 House Bill No. 4102 (the disaster contingency fund and relief for
1010 school districts located in a disaster area), to consider and
1111 take action on the following matter:
1212 Senate Rule 12.03(1) is suspended to permit the committee
1313 to change text not in disagreement in SECTION 1 of the bill, in
1414 Subsection (c), Section 418.073, Government Code, to read as
1515 follows:
1616 (c) A state or [agency,] local government[, or other
1717 eligible] entity that participates in disaster preparation or
1818 disaster recovery may request and receive funding from the
1919 disaster contingency fund to pay for[:
2020 [(1) extraordinary] costs incurred by the state or
2121 local government entity in preparing for or recovering from
2222 [implementing preventive measures taken before or during an
2323 emergency; and
2424 [(2) costs incurred in repairing damage suffered
2525 during] a disaster [for which:
2626 [(A) the presiding officer of a municipal or
2727 county government has declared a local state of disaster for
2828 affected areas within the jurisdiction of the municipality or
2929 county; and
3030 [(B) the governor has also declared a state of
3131 disaster for the affected county or counties].
3232 Explanation: This change is necessary to maintain the
3333 ability of a state or local government entity to receive
3434 reimbursement from the disaster contingency fund for costs
3535 incurred by the entity in preparing for disasters.
