44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 81st
66 Legislature, Regular Session, 2009, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 House Bill No. 1831, relating to disaster preparedness and
1010 emergency management and to certain vehicles used in
1111 emergencies, to consider and take action on the following matter:
1212 (1) Senate Rule 12.03(4) is suspended to permit the
1313 committee to add the following text to SECTION 1.20 of the bill:
1414 (13-a) "Police vehicle" means a vehicle [of a
1515 governmental entity primarily] used by a peace officer, as
1616 defined by Article 2.12, Code of Criminal Procedure, for law
1717 enforcement purposes that:
1818 (A) is owned or leased by a governmental
1919 entity;
2020 (B) is owned or leased by the police
2121 department of a private institution of higher education that
2222 commissions peace officers under Section 51.212, Education Code;
2323 or
2424 (C) is:
2525 (i) a private vehicle owned or leased by
2626 the peace officer; and
2727 (ii) approved for use for law enforcement
2828 purposes by the head of the law enforcement agency that employs
2929 the peace officer, or by that person's designee, provided that
3030 use of the private vehicle must, if applicable, comply with any
3131 rule adopted by the commissioners court of a county under Section
3232 170.001, Local Government Code, and that the private vehicle may
3333 not be considered an authorized emergency vehicle for exemption
3434 purposes under Section 228.054, 284.070, 366.178, or 370.177,
3535 Transportation Code, unless the vehicle is marked.
3636 Explanation: This change is necessary to ensure that a
3737 private vehicle is marked in order to qualify for an exemption as
3838 an authorized emergency vehicle.
3939 (2) Senate Rule 12.03(4) is suspended to permit the
4040 committee to add the following text to ARTICLE 6 of the bill:
4141 SECTION 6.01. The heading to Section 37.108, Education
4242 Code, is amended to read as follows:
4343 Sec. 37.108. MULTIHAZARD EMERGENCY OPERATIONS PLAN;
4444 SAFETY AND SECURITY AUDIT.
4545 SECTION 6.02. Section 37.108, Education Code, is amended
4646 by amending Subsections (a), (b), and (c) and adding Subsections
4747 (c-1) and (c-2) to read as follows:
4848 (a) Each school district or public junior college
4949 district shall adopt and implement a multihazard emergency
5050 operations plan for use in the district's facilities [district
5151 schools]. The plan must address mitigation, preparedness,
5252 response, and recovery as defined by the commissioner of
5353 education or commissioner of higher education in conjunction
5454 with the governor's office of homeland security. The plan must
5555 provide for:
5656 (1) district employee training in responding to an
5757 emergency;
5858 (2) if the plan applies to a school district,
5959 mandatory school drills and exercises to prepare district
6060 students and employees for responding to an emergency;
6161 (3) measures to ensure coordination with the
6262 Department of State Health Services and local emergency
6363 management agencies, law enforcement, health departments, and
6464 fire departments in the event of an emergency; and
6565 (4) the implementation of a safety and security
6666 audit as required by Subsection (b).
6767 (b) At least once every three years, each [a] school
6868 district or public junior college district shall conduct a safety
6969 and security audit of the district's facilities. To the extent
7070 possible, a district shall follow safety and security audit
7171 procedures developed by the Texas School Safety Center or a
7272 comparable public or private entity.
7373 (c) A school district or public junior college district
7474 shall report the results of the safety and security audit
7575 conducted under Subsection (b) to the district's board of
7676 trustees and, in the manner required by the Texas School Safety
7777 Center, to the Texas School Safety Center.
7878 SECTION 6.03. Subchapter D, Chapter 37, Education Code,
7979 is amended by adding Section 37.109 to read as follows:
8080 Sec. 37.109. SCHOOL SAFETY AND SECURITY COMMITTEE.
8181 (a) In accordance with guidelines established by the Texas
8282 School Safety Center, each school district shall establish a
8383 school safety and security committee.
8484 (b) The committee shall:
8585 (1) participate on behalf of the district in
8686 developing and implementing emergency plans consistent with the
8787 district multihazard emergency operations plan required by
8888 Section 37.108(a) to ensure that the plans reflect specific
8989 campus, facility, or support services needs;
9090 (2) provide the district with any campus, facility,
9191 or support services information required in connection with a
9292 safety and security audit required by Section 37.108(b), a safety
9393 and security audit report required by Section 37.108(c), or
9494 another report required to be submitted by the district to the
9595 Texas School Safety Center; and
9696 (3) review each report required to be submitted by
9797 the district to the Texas School Safety Center to ensure that the
9898 report contains accurate and complete information regarding each
9999 campus, facility, or support service in accordance with criteria
100100 established by the center.
101101 SECTION 6.04. Section 37.202, Education Code, is amended
102102 to read as follows:
103103 Sec. 37.202. PURPOSE. The purpose of the center is to
104104 serve as:
105105 (1) a central location for school safety and
106106 security information, including research, training, and
107107 technical assistance related to successful school safety and
108108 security programs; [and]
109109 (2) a central registry of persons providing school
110110 safety and security consulting services in the state; and
111111 (3) a resource for the prevention of youth violence
112112 and the promotion of safety in the state.
113113 SECTION 6.05. Section 37.203(a), Education Code, as
114114 amended by Chapters 258 (S.B. 11) and 263 (S.B. 103), Acts of the
115115 80th Legislature, Regular Session, 2007, is reenacted to read as
116116 follows:
117117 (a) The center is advised by a board of directors
118118 composed of:
119119 (1) the attorney general, or the attorney general's
120120 designee;
121121 (2) the commissioner, or the commissioner's
122122 designee;
123123 (3) the executive director of the Texas Juvenile
124124 Probation Commission, or the executive director's designee;
125125 (4) the executive commissioner of the Texas Youth
126126 Commission, or the executive commissioner's designee;
127127 (5) the commissioner of the Department of State
128128 Health Services, or the commissioner's designee;
129129 (6) the commissioner of higher education, or the
130130 commissioner's designee; and
131131 (7) the following members appointed by the governor
132132 with the advice and consent of the senate:
133133 (A) a juvenile court judge;
134134 (B) a member of a school district's board of
135135 trustees;
136136 (C) an administrator of a public primary
137137 school;
138138 (D) an administrator of a public secondary
139139 school;
140140 (E) a member of the state parent-teacher
141141 association;
142142 (F) a teacher from a public primary or
143143 secondary school;
144144 (G) a public school superintendent who is a
145145 member of the Texas Association of School Administrators;
146146 (H) a school district police officer or a
147147 peace officer whose primary duty consists of working in a public
148148 school; and
149149 (I) two members of the public.
150150 SECTION 6.06. Section 37.203(b), Education Code, is
151151 amended to read as follows:
152152 (b) Members of the board appointed under Subsection
153153 (a)(7) [(a)(6)] serve staggered two-year terms, with the terms of
154154 the members described by Subsections (a)(7)(A)-(E)
155155 [(a)(6)(A)-(E)] expiring on February 1 of each odd-numbered year
156156 and the terms of the members described by Subsections
157157 (a)(7)(F)-(I) [(a)(6)(F)-(I)] expiring on February 1 of each
158158 even-numbered year. A member may serve more than one term.
159159 SECTION 6.07. Section 37.207(a), Education Code, is
160160 amended to read as follows:
161161 (a) The center shall develop a model safety and security
162162 audit procedure for use by school districts and public junior
163163 college districts that includes:
164164 (1) providing each district with guidelines [and a
165165 training video] showing proper audit procedures;
166166 (2) reviewing elements of each district audit[,
167167 providing the results of the review to the district,] and making
168168 recommendations for improvements in the state based on that
169169 review [the audit]; and
170170 (3) incorporating the findings of district audits
171171 in a statewide report on school safety and security made
172172 available by the center to the public.
173173 SECTION 6.08. Section 37.209, Education Code, is amended
174174 to read as follows:
175175 Sec. 37.209. CENTER WEBSITE. The center shall develop
176176 and maintain an interactive Internet website that includes:
177177 (1) quarterly news updates related to school safety
178178 and security and violence prevention;
179179 (2) school crime data;
180180 (3) a schedule of training and special events; and
181181 (4) a list of persons who [approved by the board to]
182182 provide school safety or security consulting services in this
183183 state and are registered in accordance with Section 37.2091
184184 [presentations].
185185 SECTION 6.09. Subchapter G, Chapter 37, Education Code,
186186 is amended by adding Sections 37.2091 and 37.2121 to read as
187187 follows:
188188 Sec. 37.2091. REGISTRY OF PERSONS PROVIDING SCHOOL
189189 SAFETY OR SECURITY CONSULTING SERVICES. (a) In this section,
190190 "school safety or security consulting services" includes any
191191 service provided to a school district, institution of higher
192192 education, district facility, or campus by a person consisting of
193193 advice, information, recommendations, data collection, or safety
194194 and security audit services relevant to school safety and
195195 security, regardless of whether the person is paid for those
196196 services.
197197 (b) The center shall establish a registry of persons
198198 providing school safety or security consulting services in this
199199 state.
200200 (c) Each person providing school safety or security
201201 consulting services in this state shall register with the center
202202 in accordance with requirements established by the center. The
203203 requirements must include provisions requiring a person
204204 registering with the center to provide information regarding:
205205 (1) the person's background, education, and
206206 experience that are relevant to the person's ability to provide
207207 knowledgeable and effective school safety or security consulting
208208 services; and
209209 (2) any complaints or pending litigation relating
210210 to the person's provision of school safety or security consulting
211211 services.
212212 (d) The registry is intended to serve only as an
213213 informational resource for school districts and institutions of
214214 higher education. The inclusion of a person in the registry is
215215 not an indication of the person's qualifications or ability to
216216 provide school safety or security consulting services or that the
217217 center endorses the person's school safety or security
218218 consulting services.
219219 (e) The center shall include information regarding the
220220 registry, including the number of persons registered and the
221221 general degree of school safety or security experience possessed
222222 by those persons, in the biennial report required by Section
223223 37.216.
224224 Sec. 37.2121. MEMORANDA OF UNDERSTANDING AND MUTUAL AID
225225 AGREEMENTS. (a) The center shall identify and inform school
226226 districts of the types of entities, including local and regional
227227 authorities, other school districts, and emergency first
228228 responders, with whom school districts should customarily make
229229 efforts to enter into memoranda of understanding or mutual aid
230230 agreements addressing issues that affect school safety and
231231 security.
232232 (b) The center shall develop guidelines regarding
233233 memoranda of understanding and mutual aid agreements between
234234 school districts and the entities identified in accordance with
235235 Subsection (a). The guidelines:
236236 (1) must include descriptions of the provisions
237237 that should customarily be included in each memorandum or
238238 agreement with a particular type of entity;
239239 (2) may include sample language for those
240240 provisions; and
241241 (3) must be consistent with the Texas Statewide
242242 Mutual Aid System established under Subchapter E-1, Chapter 418,
243243 Government Code.
244244 (c) The center shall encourage school districts to enter
245245 into memoranda of understanding and mutual aid agreements with
246246 entities identified in accordance with Subsection (a) that
247247 comply with the guidelines developed under Subsection (b).
248248 (d) Each school district that enters into a memorandum of
249249 understanding or mutual aid agreement addressing issues that
250250 affect school safety and security shall, at the center's request,
251251 provide the following information to the center:
252252 (1) the name of each entity with which the school
253253 district has entered into a memorandum of understanding or mutual
254254 aid agreement;
255255 (2) the effective date of each memorandum or
256256 agreement; and
257257 (3) a summary of each memorandum or agreement.
258258 (e) The center shall include information regarding the
259259 center's efforts under this section in the report required by
260260 Section 37.216.
261261 SECTION 6.10. Section 37.213, Education Code, is amended
262262 to read as follows:
263263 Sec. 37.213. PUBLIC JUNIOR COLLEGES [INSTITUTIONS OF
264264 HIGHER EDUCATION]. (a) In this section, "public junior
265265 college" ["institution of higher education"] has the meaning
266266 assigned by Section 61.003.
267267 (b) The center shall research best practices regarding
268268 emergency preparedness of public junior colleges and serve as a
269269 clearinghouse for that information.
270270 (c) The center shall provide public junior colleges with
271271 training, technical assistance, and published guidelines or
272272 templates, as appropriate, in the following areas:
273273 (1) multihazard emergency operations plan
274274 development;
275275 (2) drill and exercise development and
276276 implementation;
277277 (3) mutual aid agreements;
278278 (4) identification of equipment and funds that may
279279 be used by public junior colleges in an emergency; and
280280 (5) reporting in accordance with 20 U.S.C. Section
281281 1092(f) [An institution of higher education may use any
282282 appropriate model plan developed by the center under Section
283283 37.205(4).
284284 [(c) The center may provide an institution of higher
285285 education with on-site technical assistance and safety training.
286286 [(d) The center may charge a fee to an institution of
287287 higher education for assistance and training provided under
288288 Subsection (c)].
289289 SECTION 6.11. Section 37.216, Education Code, is amended
290290 to read as follows:
291291 Sec. 37.216. BIENNIAL [ANNUAL] REPORT. (a) Not later
292292 than January [September] 1 of each odd-numbered year, the board
293293 shall provide a report to the governor, the legislature, the
294294 State Board of Education, and the agency.
295295 (b) The biennial [annual] report must include any
296296 findings made by the center regarding school safety and security
297297 and the center's functions, budget information, and strategic
298298 planning initiatives of the center.
299299 SECTION 6.12. Subchapter G, Chapter 37, Education Code,
300300 is amended by adding Section 37.2161 to read as follows:
301301 Sec. 37.2161. SCHOOL SAFETY AND SECURITY PROGRESS
302302 REPORT. (a) The center shall periodically provide a school
303303 safety and security progress report to the governor, the
304304 legislature, the State Board of Education, and the agency that
305305 contains current information regarding school safety and
306306 security in the school districts and public junior college
307307 districts of this state based on:
308308 (1) elements of each district's multihazard
309309 emergency operations plan required by Section 37.108(a);
310310 (2) elements of each district's safety and security
311311 audit required by Section 37.108(b); and
312312 (3) any other report required to be submitted to the
313313 center.
314314 (b) The center shall establish guidelines regarding the
315315 specific information to be included in the report required by
316316 this section.
317317 (c) The center may provide the report required by this
318318 section in conjunction with the report required by Section
319319 37.216.
320320 SECTION 6.13. Subchapter E, Chapter 51, Education Code,
321321 is amended by adding Section 51.217 to read as follows:
322322 Sec. 51.217. MULTIHAZARD EMERGENCY OPERATIONS PLAN;
323323 SAFETY AND SECURITY AUDIT. (a) In this section, "institution"
324324 means a general academic teaching institution, a medical and
325325 dental unit, or other agency of higher education, as those terms
326326 are defined by Section 61.003.
327327 (b) An institution shall adopt and implement a
328328 multihazard emergency operations plan for use at the
329329 institution. The plan must address mitigation, preparedness,
330330 response, and recovery. The plan must provide for:
331331 (1) employee training in responding to an
332332 emergency;
333333 (2) mandatory drills to prepare students, faculty,
334334 and employees for responding to an emergency;
335335 (3) measures to ensure coordination with the
336336 Department of State Health Services, local emergency management
337337 agencies, law enforcement, health departments, and fire
338338 departments in the event of an emergency; and
339339 (4) the implementation of a safety and security
340340 audit as required by Subsection (c).
341341 (c) At least once every three years, an institution shall
342342 conduct a safety and security audit of the institution's
343343 facilities. To the extent possible, an institution shall follow
344344 safety and security audit procedures developed in consultation
345345 with the division of emergency management of the office of the
346346 governor.
347347 (d) An institution shall report the results of the safety
348348 and security audit conducted under Subsection (c) to the
349349 institution's board of regents and the division of emergency
350350 management of the office of the governor.
351351 (e) Except as provided by Subsection (f), any document or
352352 information collected, developed, or produced during a safety
353353 and security audit conducted under Subsection (c) is not subject
354354 to disclosure under Chapter 552, Government Code.
355355 (f) A document relating to an institution's multihazard
356356 emergency operations plan is subject to disclosure if the
357357 document enables a person to:
358358 (1) verify that the institution has established a
359359 plan and determine the agencies involved in the development of
360360 the plan and the agencies coordinating with the institution to
361361 respond to an emergency, including the Department of State Health
362362 Services, local emergency services agencies, law enforcement
363363 agencies, health departments, and fire departments;
364364 (2) verify that the institution's plan was reviewed
365365 within the last 12 months and determine the specific review
366366 dates;
367367 (3) verify that the plan addresses the four phases
368368 of emergency management under Subsection (b);
369369 (4) verify that institution employees have been
370370 trained to respond to an emergency and determine the types of
371371 training, the number of employees trained, and the person
372372 conducting the training;
373373 (5) verify that each campus has conducted mandatory
374374 emergency drills and exercises in accordance with the plan and
375375 determine the frequency of the drills;
376376 (6) verify that the institution has completed a
377377 safety and security audit under Subsection (c) and determine the
378378 date the audit was conducted, the person conducting the audit,
379379 and the date the institution presented the results of the audit
380380 to the board of regents; and
381381 (7) verify that the institution has addressed any
382382 recommendations by the board of regents for improvement of the
383383 plan and determine the institution's progress within the last 12
384384 months.
385385 SECTION 6.13a. Chapter 111, Education Code, is amended
386386 by adding Subchapter I to read as follows:
387387 SUBCHAPTER I. UNIVERSITY OF HOUSTON HURRICANE CENTER FOR
388388 INNOVATIVE TECHNOLOGY
389389 Sec. 111.121. DEFINITIONS. In this subchapter:
390390 (1) "Board" means the board of regents of the
391391 University of Houston System.
392392 (2) "Center" means the University of Houston
393393 Hurricane Center for Innovative Technology (UHC-IT) established
394394 under this subchapter.
395395 Sec. 111.122. ESTABLISHMENT. (a) The University of
396396 Houston Hurricane Center for Innovative Technology is
397397 established at the University of Houston.
398398 (b) The organization, control, and management of the
399399 center are vested in the board.
400400 (c) The center shall be hosted by the university's
401401 College of Engineering. Participation in the center's
402402 activities shall be open to any faculty member of the university
403403 who is an active researcher in the field of materials,
404404 nanotechnology, structural engineering, designing of
405405 structures, or sensor technology, or in another relevant field as
406406 determined by the university.
407407 Sec. 111.123. PURPOSE. The center is created to:
408408 (1) promote interdisciplinary research, education,
409409 and training for the development of state-of-the-art products,
410410 materials, systems, and technologies designed to mitigate the
411411 wind, and asserted structural damages in the built environment
412412 and offshore structures caused by hurricanes in the Gulf Coast
413413 region; and
414414 (2) develop protocols for the fast and efficient
415415 recovery of the public and private sectors, including utilities,
416416 hospitals, petrochemical industries, offshore platforms, and
417417 municipalities and other local communities following a
418418 hurricane.
419419 Sec. 111.124. POWERS AND DUTIES. The center shall:
420420 (1) collaborate with appropriate federal, state,
421421 and local agencies and private business or nonprofit entities as
422422 necessary to coordinate efforts after a hurricane in the Gulf
423423 Coast region;
424424 (2) develop smart materials and devices for use in
425425 hurricane protection and mitigation systems for structural
426426 monitoring;
427427 (3) develop anchor systems for window and door
428428 screens, dwellings and other buildings, pipelines, and other
429429 onshore and offshore structures to withstand hurricane wind
430430 damage;
431431 (4) develop test facilities for evaluating the
432432 performance of new products, materials, or techniques designed
433433 to protect against hurricane wind damage;
434434 (5) develop specifications and standards for
435435 products used for protecting against hurricane wind damage;
436436 (6) design buildings, houses, and other structures
437437 to withstand hurricane wind damage; and
438438 (7) provide hurricane-related educational
439439 programs, seminars, conferences, and workshops to the community
440440 designed to ensure safety, minimize loss of life, and mitigate
441441 the destruction of property associated with hurricane wind
442442 damage.
443443 Sec. 111.125. COLLABORATION WITH OTHER ENTITIES. The
444444 University of Houston shall encourage public and private
445445 entities to participate in or support the operation of the center
446446 and may enter into an agreement with any public or private entity
447447 for that purpose. An agreement may allow the center to provide
448448 information, services, or other assistance to an entity in
449449 exchange for the entity's participation or support.
450450 Sec. 111.126. GIFTS AND GRANTS. The board may solicit,
451451 accept, and administer gifts and grants from any public or
452452 private source and use existing resources for the purposes of the
453453 center. State funding is not available unless the legislature
454454 makes specific appropriation for this purpose.
455455 Sec. 111.127. PERSONNEL. The board may employ personnel
456456 for the center as necessary.
457457 SECTION 6.14. Section 418.004(10), Government Code, is
458458 amended to read as follows:
459459 (10) "Local government entity" means a county,
460460 incorporated city, independent school district, public junior
461461 college district, emergency services district, other special
462462 district, joint board, or other entity defined as a political
463463 subdivision under the laws of this state that maintains the
464464 capability to provide mutual aid.
465465 SECTION 6.15. Section 37.210, Education Code, is
466466 repealed.
467467 SECTION 6.17. A person providing school safety or
468468 security consulting services in this state shall comply with
469469 Section 37.2091, Education Code, as added by this article, not
470470 later than January 1, 2010.
471471 SECTION 6.18. This article does not make an
472472 appropriation. A provision in this article that creates a new
473473 governmental program, creates a new entitlement, or imposes a new
474474 duty on a governmental entity is not mandatory during a fiscal
475475 period for which the legislature has not made a specific
476476 appropriation to implement the provision.
477477 SECTION 6.19. This article takes effect September 1,
478478 2009.
479479 Explanation: This change is necessary to require public
480480 junior college districts to adopt and implement a multihazard
481481 emergency operation plan, to establish school safety and
482482 security committees, and to establish the University of Houston
483483 Hurricane Center for Innovative Technology.
484484 (3) Senate Rule 12.03(1) is suspended to permit the
485485 committee to change text that is not in disagreement in SECTION
486486 6.16 of the bill so that section reads as follows:
487487 SECTION 6.16. Sections 37.108(c-1) and (c-2), and
488488 Sections 51.217(d) and (e), Education Code, as added by this
489489 article, apply only to a request for documents or information
490490 that is received on or after the effective date of this article.
491491 A request for documents or information that was received before
492492 the effective date of this article is governed by the law in
493493 effect on the date the request was received, and the former law is
494494 continued in effect for that purpose.
495495 Explanation: This change is necessary to add a
496496 cross-reference to Subsections (d) and (e), Section 51.217,
497497 Education Code, to the transition provisions of the bill.
