44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, That
66 the Rules of the Senate of the 80th Legislature are adopted as the
77 Permanent Rules of the Senate of the 81st Legislature with the
88 following modifications:
99 1. Amend Rule 5.11 to read as follows:
1010 SPECIAL ORDERS
1111 Rule 5.11. (a) Any bill, resolution, or other measure
1212 may on any day be made a special order for a future time of the
1313 session by an affirmative vote of two-thirds of the members
1414 present.
1515 (b) A special order shall be considered at the time for
1616 which it is set and considered from day to day until disposed of,
1717 unless at the time so fixed there is pending business under a
1818 special order, but such pending business may be suspended by a
1919 two-thirds vote of all the members present. If a special order is
2020 not reached or considered at the time fixed, it shall not lose its
2121 place as a special order. All special orders shall be subject to
2222 any Joint Rules and Rule 5.10.
2323 (c) Upon the affirmative vote of four-fifths of the
2424 members present, a special order may be reset to an earlier time
2525 than previously scheduled.
2626 (d) Notwithstanding Subsection (a) of this rule, a bill
2727 or resolution relating to voter identification requirements
2828 reported favorably from the Committee of the Whole Senate may be
2929 set as a special order for a time at least 24 hours after the
3030 motion is adopted by a majority of the members of the Senate.
3131 2. Amend Rule 6.15 to read as follows:
3232 WHEN RECORD VOTE REQUIRED; CALLS FOR YEAS
3333 AND NAYS [REQUIRED]
3434 Rule 6.15. (a)(1) A vote on [Upon the] final passage of
3535 a bill, a resolution proposing or ratifying a constitutional
3636 amendment, or a resolution other than a resolution of a purely
3737 ceremonial or honorary nature, shall be by record vote, with the
3838 vote of each member entered in the journal.
3939 (2) A vote on [all amendments proposed to the
4040 Constitution, all bills appropriating money or lands for any
4141 purpose, all bills containing an immediate effect clause,] all
4242 motions to suspend the constitutional three-day rule, [and] all
4343 questions requiring a vote of two-thirds of the members elected,
4444 all motions on whether to concur in House amendments to Senate
4545 bills, and all motions on whether to adopt a conference committee
4646 report shall be by record vote, with the vote of each member [the
4747 presiding officer shall call for the yeas and nays, and they
4848 shall be] entered in the journal.
4949 (3) Upon all other questions requiring a vote of
5050 two-thirds of the members present, including a motion to suspend
5151 the rules, the presiding officer shall determine if there is
5252 objection and, if so, call for the yeas and nays, but they shall
5353 not be entered into the journal unless required under Subsection
5454 (b) of this rule. If no objection is made, the journal entry
5555 shall reflect a unanimous consent vote of the members present
5656 without necessity of a roll call of yeas and nays.
5757 (b) On any other question, at [At] the desire of any three
5858 members present, the yeas and nays shall be entered on the
5959 journal, and the names of the members present and not voting
6060 shall be recorded immediately after those voting in the
6161 affirmative and negative, and such members shall be counted in
6262 determining the presence of a quorum. (Constitution, Article
6363 III, Section 12)
6464 (c)(1) Any nonprocedural motion adopted by voice vote,
6565 without objection, or with unanimous consent shall be reflected
6666 in the journal by showing members present as "yea", unless a
6767 member registers otherwise with the Secretary of the Senate.
6868 (2) The following statement shall be entered in the
6969 journal after each vote taken as provided in Subdivision (1) of
7070 this subsection:
7171 "All members are deemed to have voted 'Yea' except as
7272 follows:
7373 Nays:
7474 PNV:
7575 Absent-Excused:
7676 Absent:"
7777 (d) A member must be on the floor of the Senate or in an
7878 adjacent room or hallway on the same level as the Senate floor or
7979 gallery in order to vote; but a member who is out of the Senate
8080 when a record vote is taken and who wishes to be recorded shall be
8181 permitted to do so provided:
8282 (1) the member was out of the Senate temporarily,
8383 having been recorded earlier as present;
8484 (2) the vote is submitted to the Secretary of the
8585 Senate prior to adjournment or recess to another calendar day;
8686 and
8787 (3) the recording of the member's vote does not
8888 change the result as announced by the chair.
8989 (e) Once begun, a roll call may not be interrupted for any
9090 reason.
9191 3. Amend Rule 16.07 as follows:
9292 MATTERS REQUIRING VOTE OF MAJORITY
9393 OF MEMBERS OF SENATE
9494 Rule 16.07. A vote of the majority of the members of the
9595 Senate is required to:
9696 (1) pass a resolution initially adopting temporary
9797 or permanent rules of the Senate; Rule 21.01
9898 (2) adopt, amend, or rescind any Joint Rules of the
9999 two Houses; Rules 21.02 and 22.02
100100 (3) adopt resolution to suspend conference
101101 committee rules; Rule 12.08
102102 (4) commit or recommit bill, resolution, or
103103 petition to a committee; Rule 6.08
104104 (5) hold an executive session; Rule 15.02
105105 (6) pass a resolution amending the Rules of the
106106 Senate;[.] Rule 22.01
107107 (7) set voter identification requirement bills for
108108 special order; Rule 5.11(d).
