11 SENATE RESOLUTION NO. 141
22 WHEREAS, The office of justice of the peace, first
33 established in 1362 by King Edward of England, and the office of
44 constable, first established in 1215 by King John of England,
55 were two of the first offices established in the American
66 colonies in 1620; and
77 WHEREAS, In Texas, both offices were created by the Texas
88 Constitution, and they serve a vital role in the delivery of
99 county government responsibilities to citizens on the local
1010 level; and
1111 WHEREAS, The justices of the peace are an integral part of
1212 the Texas judiciary; they exercise jurisdiction in criminal
1313 misdemeanor cases punishable by fine or sanctions and exercise
1414 civil jurisdiction in matters of controversy under $5,000;
1515 justices of the peace preside over those courts closest to the
1616 people and were first established as "grass roots" courts in 1836
1717 when Texas became a republic; and
1818 WHEREAS, The constables serve as officers of the court as
1919 bailiffs, execute civil and criminal processes issued by Texas
2020 courts, and enforce criminal laws as certified peace officers;
2121 constables were first documented in Texas in 1823 by Stephen F.
2222 Austin when Texas was still under Mexican rule; and
2323 WHEREAS, The men and women who accept the responsibilities
2424 of the offices of justice of the peace and constable perform the
2525 duties of their office with integrity, dedication, and the
2626 required knowledge of the law, thereby contributing immeasurably
2727 to the justice system, the safety of the citizens of Texas, and
2828 the peace and order of our society; and
2929 WHEREAS, The Justices of the Peace and Constables
3030 Association of Texas, Incorporated, has represented the
3131 interests of more than 4,000 Texas justices of the peace,
3232 constables, and members of their staffs for over 60 years; and
3333 WHEREAS, The dedication of a special day to focus attention
3434 on the contributions of these public officials to our state is
3535 appropriate and will enlighten the public as to their role in our
3636 judicial system; now, therefore, be it
3737 RESOLVED, That the Senate of the State of Texas, 81st
3838 Legislature, hereby proclaim February 25, 2009, Justices of the
3939 Peace and Constables Day, welcome the visiting members of the
4040 Justices of the Peace and Constables Association of Texas,
4141 Incorporated, to the State Capitol, and commend the justices of
4242 the peace and constables of our state for serving and protecting
4343 the citizens of Texas; and, be it further
4444 RESOLVED, That a copy of this Resolution be prepared for
4545 the Justices of the Peace and Constables Association of Texas,
4646 Incorporated, as an expression of high regard from the Texas
4747 Senate.
