99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to enforcement of commercial motor vehicle safety
1212 standards in certain municipalities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 644.101(b), Transportation Code, is
1515 amended to read as follows:
1616 (b) A police officer of any of the following municipalities
1717 is eligible to apply for certification under this section:
1818 (1) a municipality with a population of 50,000 or
1919 more;
2020 (2) a municipality with a population of 25,000 or more
2121 any part of which is located in a county with a population of
2222 500,000 or more;
2323 (3) a municipality with a population of less than
2424 25,000:
2525 (A) any part of which is located in a county with
2626 a population of 2.4 million; and
2727 (B) that contains or is adjacent to an
2828 international port;
2929 (4) a municipality with a population of at least
3030 34,000 that is located in a county that borders two or more states;
3131 (5) a municipality any part of which is located in a
3232 county bordering the United Mexican States; [or]
3333 (6) a municipality with a population of less than
3434 5,000 that is located:
3535 (A) adjacent to a bay connected to the Gulf of
3636 Mexico; and
3737 (B) in a county adjacent to a county with a
3838 population greater than 3.3 million;
3939 (7) a municipality that is located:
4040 (A) within 25 miles of an international port; and
4141 (B) in a county that does not contain a highway
4242 that is part of the national system of interstate and defense
4343 highways and is adjacent to a county with a population greater than
4444 3.3 million; or
4545 (8) a municipality with a population of less than
4646 8,500 that:
4747 (A) is the county seat; and
4848 (B) contains a highway that is part of the
4949 national system of interstate and defense highways.
5050 SECTION 2. This Act takes effect September 1, 2011.
