66 AN ACT
77 relating to minimum liability insurance coverage amounts for
88 persons convicted of offenses related to the operation of a motor
99 vehicle while intoxicated.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 601.072, Transportation Code, is amended
1212 by adding Subsections (a-2) and (a-3) to read as follows:
1313 (a-2) A person convicted of an offense relating to the
1414 operating of a motor vehicle while intoxicated must maintain, in
1515 addition to the minimum coverage required by this section,
1616 additional motor vehicle liability insurance coverage to establish
1717 financial responsibility under this chapter. The amounts of
1818 liability coverage required increase by $25,000 for each
1919 conviction.
2020 (a-3) In this section, "offense relating to the operating of
2121 a motor vehicle while intoxicated" has the meaning assigned by
2222 Section 49.09, Penal Code.
2323 SECTION 2. Section 601.072, Transportation Code, as amended
2424 by this Act, applies only to an offense committed on or after the
2525 effective date of this Act. An offense committed before the
2626 effective date of this Act is governed by the law in effect
2727 immediately before that date, and the former law is continued in
2828 effect for that purpose. For purposes of this section, an offense
2929 was committed before the effective date of this Act if any element
3030 of the offense occurred before that date.
3131 SECTION 3. This Act takes effect September 1, 2011.
