| 7 | 7 | | relating to minimum liability insurance coverage amounts for |

| 8 | 8 | | persons convicted of offenses related to the operation of a motor |

| 9 | 9 | | vehicle while intoxicated. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 601.072, Transportation Code, is amended |
|---|
| 12 | 12 | | by adding Subsections (a-2) and (a-3) to read as follows: |
|---|
| 13 | 13 | | (a-2) A person convicted of an offense relating to the |
|---|
| 14 | 14 | | operating of a motor vehicle while intoxicated must maintain, in |
|---|
| 15 | 15 | | addition to the minimum coverage required by this section, |
|---|
| 16 | 16 | | additional motor vehicle liability insurance coverage to establish |
|---|
| 17 | 17 | | financial responsibility under this chapter. The amounts of |
|---|
| 18 | 18 | | liability coverage required increase by $25,000 for each |
|---|
| 19 | 19 | | conviction. |
|---|
| 20 | 20 | | (a-3) In this section, "offense relating to the operating of |
|---|
| 21 | 21 | | a motor vehicle while intoxicated" has the meaning assigned by |
|---|
| 22 | 22 | | Section 49.09, Penal Code. |
|---|
| 23 | 23 | | SECTION 2. Section 601.072, Transportation Code, as amended |
|---|
| 24 | 24 | | by this Act, applies only to an offense committed on or after the |
|---|
| 25 | 25 | | effective date of this Act. An offense committed before the |
|---|
| 26 | 26 | | effective date of this Act is governed by the law in effect |
|---|
| 27 | 27 | | immediately before that date, and the former law is continued in |
|---|
| 28 | 28 | | effect for that purpose. For purposes of this section, an offense |
|---|
| 29 | 29 | | was committed before the effective date of this Act if any element |
|---|
| 30 | 30 | | of the offense occurred before that date. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2011. |
