77 relating to initial claims under the unemployment compensation
88 system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 208.002, Labor Code, is amended to read
1111 as follows:
1212 Sec. 208.002. [NOTICE OF] INITIAL CLAIM; LAST WORK. (a)
1313 When used in connection with an initial claim, "last work" and
1414 "person for whom the claimant last worked" refer to:
1515 (1) the last person for whom the claimant actually
1616 worked, if the claimant worked for that person for at least 30 hours
1717 during a week; or
1818 (2) the employer, as defined by Subchapter C, Chapter
1919 201, or by the unemployment law of any other state, for whom the
2020 claimant last worked.
2121 (b) The commission shall mail a notice of the filing of an
2222 initial claim to the person for whom the claimant last worked before
2323 the effective date of the initial claim. If the person for whom the
2424 claimant last worked has more than one branch or division operating
2525 at different locations, the commission shall mail the notice to the
2626 branch or division at which the claimant last worked.
2727 (c) [(b)] Mailing of a notice under this section to the
2828 correct address of the person, branch, or division for which the
2929 claimant last worked constitutes notice of the claim to the person.
3030 SECTION 2. The changes in law made by this Act apply only to
3131 a claim for unemployment compensation benefits that is filed with
3232 the Texas Workforce Commission on or after the effective date of
3333 this Act. A claim filed before that date is governed by the law in
3434 effect on the date the claim was filed, and the former law is
3535 continued in effect for that purpose.
3636 SECTION 3. This Act takes effect September 1, 2011.
