| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subtitle A, Title 4, Local Government Code, is |

| 13 | 13 | | amended by adding Chapter 109 to read as follows: |

| 14 | 14 | | CHAPTER 109. FEES CHARGED BY MUNICIPAL OFFICERS |

| 15 | 15 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 16 | 16 | | Sec. 109.001. APPLICABILITY. This chapter applies only to |
|---|
| 17 | 17 | | a municipality in a county with a population of more than one |
|---|
| 18 | 18 | | million. |

| 20 | 20 | | SUBCHAPTER B. FEES OF MUNICIPAL CLERK |
|---|
| 21 | 21 | | Sec. 109.021. RECORDS MANAGEMENT AND PRESERVATION FEE. |
|---|
| 22 | 22 | | (a) A municipality may impose a fee not to exceed $5 for records |
|---|
| 23 | 23 | | management and preservation services performed by a municipal clerk |
|---|
| 24 | 24 | | for a historical municipal document requested from the office of |
|---|
| 25 | 25 | | the clerk. |
|---|
| 26 | 26 | | (b) The person requesting the document must pay the fee when |
|---|
| 27 | 27 | | the document is requested. |
|---|
| 28 | 28 | | (c) The governing body of the municipality shall set the fee |
|---|
| 29 | 29 | | and determine the documents that qualify as historical municipal |
|---|
| 30 | 30 | | documents under this section. |
|---|
| 31 | 31 | | (d) The fee may be used only by the municipal clerk for |
|---|
| 32 | 32 | | specific records management and preservation of municipal records. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2011. |
