1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 4, Local Government Code, is
1313 amended by adding Chapter 109 to read as follows:
1414 CHAPTER 109. FEES CHARGED BY MUNICIPAL OFFICERS
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 109.001. APPLICABILITY. This chapter applies only to
1717 a municipality in a county with a population of more than one
1818 million.

2020 SUBCHAPTER B. FEES OF MUNICIPAL CLERK
2121 Sec. 109.021. RECORDS MANAGEMENT AND PRESERVATION FEE.
2222 (a) A municipality may impose a fee not to exceed $5 for records
2323 management and preservation services performed by a municipal clerk
2424 for a historical municipal document requested from the office of
2525 the clerk.
2626 (b) The person requesting the document must pay the fee when
2727 the document is requested.
2828 (c) The governing body of the municipality shall set the fee
2929 and determine the documents that qualify as historical municipal
3030 documents under this section.
3131 (d) The fee may be used only by the municipal clerk for
3232 specific records management and preservation of municipal records.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
