77 relating to the purchase of replacement personal computers by state

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 2157, Government Code, is
1111 amended by adding Section 2157.007 to read as follows:
1212 Sec. 2157.007. PURCHASE OF PERSONAL COMPUTERS BY STATE
1313 AGENCY. (a) In this section:
1414 (1) "Personal computer" means a laptop, desktop, tower
1515 computer system, or other personal computer that contains a central
1616 processing unit, random access memory, and a storage device.
1717 (2) "State agency" does not include an institution of
1818 higher education as defined by Section 61.003, Education Code.
1919 (b) Except as provided by Subsection (c), a state agency may
2020 not purchase a new personal computer to replace an existing
2121 personal computer of the agency before the fourth anniversary of
2222 the date the existing personal computer was purchased.
2323 (c) A state agency may purchase a new personal computer to
2424 replace an existing personal computer of the agency before the
2525 fourth anniversary of the date the existing personal computer was
2626 purchased if the agency determines that the purchase is to be made
2727 under emergency circumstances as established by the comptroller.
2828 (d) The comptroller shall adopt rules establishing
2929 circumstances under which a state agency may make an emergency
3030 purchase under Subsection (c).
3131 SECTION 2. (a) This Act applies to a purchase made on or
3232 after August 1, 2012. A purchase made before August 1, 2012, is
3333 governed by the law as it existed immediately before the effective
3434 date of this Act, and that law is continued in effect for that
3535 purpose.
3636 (b) The comptroller shall adopt rules required by Section
3737 2157.007(d), Government Code, as added by this Act, not later than
3838 March 1, 2012.
3939 SECTION 3. This Act takes effect September 1, 2011.
