| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 2157, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2157.007 to read as follows: |
|---|
| 12 | 12 | | Sec. 2157.007. PURCHASE OF PERSONAL COMPUTERS BY STATE |
|---|
| 13 | 13 | | AGENCY. (a) In this section: |
|---|
| 14 | 14 | | (1) "Personal computer" means a laptop, desktop, tower |
|---|
| 15 | 15 | | computer system, or other personal computer that contains a central |
|---|
| 16 | 16 | | processing unit, random access memory, and a storage device. |
|---|
| 17 | 17 | | (2) "State agency" does not include an institution of |
|---|
| 18 | 18 | | higher education as defined by Section 61.003, Education Code. |
|---|
| 19 | 19 | | (b) Except as provided by Subsection (c), a state agency may |
|---|
| 20 | 20 | | not purchase a new personal computer to replace an existing |
|---|
| 21 | 21 | | personal computer of the agency before the fourth anniversary of |
|---|
| 22 | 22 | | the date the existing personal computer was purchased. |
|---|
| 23 | 23 | | (c) A state agency may purchase a new personal computer to |
|---|
| 24 | 24 | | replace an existing personal computer of the agency before the |
|---|
| 25 | 25 | | fourth anniversary of the date the existing personal computer was |
|---|
| 26 | 26 | | purchased if the agency determines that the purchase is to be made |
|---|
| 27 | 27 | | under emergency circumstances as established by the comptroller. |
|---|
| 28 | 28 | | (d) The comptroller shall adopt rules establishing |
|---|
| 29 | 29 | | circumstances under which a state agency may make an emergency |
|---|
| 30 | 30 | | purchase under Subsection (c). |
|---|
| 31 | 31 | | SECTION 2. (a) This Act applies to a purchase made on or |
|---|
| 32 | 32 | | after August 1, 2012. A purchase made before August 1, 2012, is |
|---|
| 33 | 33 | | governed by the law as it existed immediately before the effective |
|---|
| 34 | 34 | | date of this Act, and that law is continued in effect for that |
|---|
| 35 | 35 | | purpose. |
|---|
| 36 | 36 | | (b) The comptroller shall adopt rules required by Section |
|---|
| 37 | 37 | | 2157.007(d), Government Code, as added by this Act, not later than |
|---|
| 38 | 38 | | March 1, 2012. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2011. |
|---|
