| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 33.003(e), Family Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (e) The court shall appoint a guardian ad litem for the |
|---|
| 16 | 16 | | minor. If the minor has not retained an attorney, the court shall |
|---|
| 17 | 17 | | appoint an attorney to represent the minor. The [If the guardian ad |
|---|
| 18 | 18 | | litem is an attorney admitted to the practice of law in this state, |
|---|
| 19 | 19 | | the] court may not appoint the guardian ad litem to serve as the |
|---|
| 20 | 20 | | minor's attorney. The court may not appoint the minor's attorney to |
|---|
| 21 | 21 | | be the guardian ad litem for the minor. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an application for a court order authorizing a minor to consent |
|---|
| 24 | 24 | | to an abortion filed under Section 33.003, Family Code, as amended |
|---|
| 25 | 25 | | by this Act, on or after the effective date of this Act. An |
|---|
| 26 | 26 | | application filed before the effective date of this Act is governed |
|---|
| 27 | 27 | | by the law in effect at the time the application was filed, and that |
|---|
| 28 | 28 | | law is continued in effect for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2011. |
