88 AN ACT
99 relating to the appointment of a guardian ad litem and attorney for
1010 a minor in an application for a court order authorizing the minor to
1111 consent to an abortion.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 33.003(e), Family Code, is amended to
1414 read as follows:
1515 (e) The court shall appoint a guardian ad litem for the
1616 minor. If the minor has not retained an attorney, the court shall
1717 appoint an attorney to represent the minor. The [If the guardian ad
1818 litem is an attorney admitted to the practice of law in this state,
1919 the] court may not appoint the guardian ad litem to serve as the
2020 minor's attorney. The court may not appoint the minor's attorney to
2121 be the guardian ad litem for the minor.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an application for a court order authorizing a minor to consent
2424 to an abortion filed under Section 33.003, Family Code, as amended
2525 by this Act, on or after the effective date of this Act. An
2626 application filed before the effective date of this Act is governed
2727 by the law in effect at the time the application was filed, and that
2828 law is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect September 1, 2011.
