99 relating to the availability on the Internet of reports of
1010 political expenditures and contributions filed in connection with
1111 certain county and municipal offices.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Section 254.0401, Election Code,
1414 is amended to read as follows:
1515 Sec. 254.0401. AVAILABILITY OF [ELECTRONIC] REPORTS ON
1616 INTERNET.
1717 SECTION 2. Section 254.0401, Election Code, is amended by
1818 adding Subsections (a-1) and (c) and amending Subsection (f) to
1919 read as follows:
2020 (a-1) The county clerk of a county with a population of
2121 800,000 or more shall make a report filed with the clerk by a
2222 candidate, officeholder, or specific-purpose committee under this
2323 subchapter in connection with a county office or the office of
2424 county commissioner available to the public on the county's
2525 Internet website not later than the second business day after the
2626 date the report is filed.
2727 (c) The clerk of a municipality with a population of 500,000
2828 or more shall make a report filed with the clerk by a candidate,
2929 officeholder, or specific-purpose committee under this subchapter
3030 in connection with the office of mayor or member of the
3131 municipality's governing body available to the public on the
3232 municipality's Internet website not later than the second business
3333 day after the date the report is filed.
3434 (f) The commission shall clearly state on the Internet
3535 website on which reports are provided [under Subsection (b)] that
3636 reports filed by an independent candidate, a third-party candidate,
3737 or a specific-purpose committee for supporting or opposing an
3838 independent or third-party candidate will not be available if the
3939 candidate or committee has not yet filed a report.
4040 SECTION 3. (a) Section 254.0401(b), Election Code, is
4141 repealed.
4242 (b) Effective January 1, 2012, Section 176.009(b), Local
4343 Government Code, is repealed.
4444 SECTION 4. Section 254.0401, Election Code, as amended by
4545 this Act, and Section 176.009, Local Government Code, as amended by
4646 this Act, apply only to a report of political contributions and
4747 expenditures that is required to be filed under Chapter 254,
4848 Election Code, on or after January 1, 2012.
4949 SECTION 5. Except as otherwise provided by this Act, this
5050 Act takes effect September 1, 2011.
