| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. The heading to Section 254.0401, Election Code, |
|---|
| 14 | 14 | | is amended to read as follows: |
|---|
| 15 | 15 | | Sec. 254.0401. AVAILABILITY OF [ELECTRONIC] REPORTS ON |
|---|
| 16 | 16 | | INTERNET. |
|---|
| 17 | 17 | | SECTION 2. Section 254.0401, Election Code, is amended by |
|---|
| 18 | 18 | | adding Subsections (a-1) and (c) and amending Subsection (f) to |
|---|
| 19 | 19 | | read as follows: |
|---|
| 20 | 20 | | (a-1) The county clerk of a county with a population of |
|---|
| 21 | 21 | | 800,000 or more shall make a report filed with the clerk by a |
|---|
| 22 | 22 | | candidate, officeholder, or specific-purpose committee under this |
|---|
| 23 | 23 | | subchapter in connection with a county office or the office of |
|---|
| 24 | 24 | | county commissioner available to the public on the county's |
|---|
| 25 | 25 | | Internet website not later than the second business day after the |
|---|
| 26 | 26 | | date the report is filed. |
|---|
| 27 | 27 | | (c) The clerk of a municipality with a population of 500,000 |
|---|
| 28 | 28 | | or more shall make a report filed with the clerk by a candidate, |
|---|
| 29 | 29 | | officeholder, or specific-purpose committee under this subchapter |
|---|
| 30 | 30 | | in connection with the office of mayor or member of the |
|---|
| 31 | 31 | | municipality's governing body available to the public on the |
|---|
| 32 | 32 | | municipality's Internet website not later than the second business |
|---|
| 33 | 33 | | day after the date the report is filed. |
|---|
| 34 | 34 | | (f) The commission shall clearly state on the Internet |
|---|
| 35 | 35 | | website on which reports are provided [under Subsection (b)] that |
|---|
| 36 | 36 | | reports filed by an independent candidate, a third-party candidate, |
|---|
| 37 | 37 | | or a specific-purpose committee for supporting or opposing an |
|---|
| 38 | 38 | | independent or third-party candidate will not be available if the |
|---|
| 39 | 39 | | candidate or committee has not yet filed a report. |

| 40 | 40 | | SECTION 3. (a) Section 254.0401(b), Election Code, is |
|---|
| 41 | 41 | | repealed. |
|---|
| 42 | 42 | | (b) Effective January 1, 2012, Section 176.009(b), Local |
|---|
| 43 | 43 | | Government Code, is repealed. |
|---|
| 44 | 44 | | SECTION 4. Section 254.0401, Election Code, as amended by |
|---|
| 45 | 45 | | this Act, and Section 176.009, Local Government Code, as amended by |
|---|
| 46 | 46 | | this Act, apply only to a report of political contributions and |
|---|
| 47 | 47 | | expenditures that is required to be filed under Chapter 254, |
|---|
| 48 | 48 | | Election Code, on or after January 1, 2012. |

| 49 | 49 | | SECTION 5. Except as otherwise provided by this Act, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2011. |
