10 | 10 | | term before a person may be appointed as a member of a local school |

11 | 11 | | health advisory council. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 28.004(d), Education Code, is amended to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (d) The board of trustees shall appoint at least five |
---|
16 | 16 | | members to the local school health advisory council. A person may |
---|
17 | 17 | | be appointed as a member of the council only if, before appointment, |
---|
18 | 18 | | the person agrees to serve for at least one year. A majority of the |
---|
19 | 19 | | members must be persons who are parents of students enrolled in the |
---|
20 | 20 | | district and who are not employed by the district. One of those |
---|
21 | 21 | | members shall serve as chair or co-chair of the council. The board |
---|
22 | 22 | | of trustees also may appoint one or more persons from each of the |
---|
23 | 23 | | following groups or a representative from a group other than a group |
---|
24 | 24 | | specified under this subsection: |
---|
25 | 25 | | (1) public school teachers; |
---|
26 | 26 | | (2) public school administrators; |
---|
27 | 27 | | (3) district students; |
---|
28 | 28 | | (4) health care professionals; |
---|
29 | 29 | | (5) the business community; |
---|
30 | 30 | | (6) law enforcement; |
---|
31 | 31 | | (7) senior citizens; |
---|
32 | 32 | | (8) the clergy; and |
---|
33 | 33 | | (9) nonprofit health organizations. |
---|
34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2011. |
