| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2161.001(3), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (3) "Economically disadvantaged person" means a |
|---|
| 14 | 14 | | person who is economically disadvantaged because of the person's |
|---|
| 15 | 15 | | identification as a member of a certain group, including Black |
|---|
| 16 | 16 | | Americans, Hispanic Americans, women, Asian Pacific Americans, |
|---|
| 17 | 17 | | [and] Native Americans, and veterans as defined by 38 U.S.C. |
|---|
| 18 | 18 | | Section 101(2) who have a service-connected disability as defined |
|---|
| 19 | 19 | | by 38 U.S.C. Section 101(16), and who has suffered the effects of |
|---|
| 20 | 20 | | discriminatory practices or other similar insidious circumstances |
|---|
| 21 | 21 | | over which the person has no control. |
|---|
| 22 | 22 | | SECTION 2. Section 2161.125, Government Code, is amended to |
|---|
| 23 | 23 | | read as follows: |

| 24 | 24 | | Sec. 2161.125. CATEGORIZATION OF HISTORICALLY |
|---|
| 25 | 25 | | UNDERUTILIZED BUSINESSES [BY SEX, RACE, AND ETHNICITY]. The |
|---|
| 26 | 26 | | comptroller, in cooperation with each state agency reporting under |
|---|
| 27 | 27 | | this subchapter, shall categorize each historically underutilized |
|---|
| 28 | 28 | | business included in a report under this subchapter by sex, race, |
|---|
| 29 | 29 | | and ethnicity and by whether the business qualifies as a |
|---|
| 30 | 30 | | historically underutilized business because it is owned or owned, |
|---|
| 31 | 31 | | operated, and controlled, as applicable, wholly or partly by one or |
|---|
| 32 | 32 | | more veterans as defined by 38 U.S.C. Section 101(2) who have a |
|---|
| 33 | 33 | | service-connected disability as defined by 38 U.S.C. Section |
|---|
| 34 | 34 | | 101(16). |

| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2011. |
