77 relating to considering ownership interests of certain disabled
88 veterans in determining whether a business is a historically
99 underutilized business for purposes of state contracting.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2161.001(3), Government Code, is amended
1212 to read as follows:
1313 (3) "Economically disadvantaged person" means a
1414 person who is economically disadvantaged because of the person's
1515 identification as a member of a certain group, including Black
1616 Americans, Hispanic Americans, women, Asian Pacific Americans,
1717 [and] Native Americans, and veterans as defined by 38 U.S.C.
1818 Section 101(2) who have a service-connected disability as defined
1919 by 38 U.S.C. Section 101(16), and who has suffered the effects of
2020 discriminatory practices or other similar insidious circumstances
2121 over which the person has no control.
2222 SECTION 2. Section 2161.125, Government Code, is amended to
2323 read as follows:
2424 Sec. 2161.125. CATEGORIZATION OF HISTORICALLY
2525 UNDERUTILIZED BUSINESSES [BY SEX, RACE, AND ETHNICITY]. The
2626 comptroller, in cooperation with each state agency reporting under
2727 this subchapter, shall categorize each historically underutilized
2828 business included in a report under this subchapter by sex, race,
2929 and ethnicity and by whether the business qualifies as a
3030 historically underutilized business because it is owned or owned,
3131 operated, and controlled, as applicable, wholly or partly by one or
3232 more veterans as defined by 38 U.S.C. Section 101(2) who have a
3333 service-connected disability as defined by 38 U.S.C. Section
3434 101(16).
3535 SECTION 3. This Act takes effect September 1, 2011.
