99 relating to the use of the fund for veterans' assistance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 434.017(c), Government Code, is amended
1212 to read as follows:
1313 (c) Money in the fund may be appropriated to the Texas
1414 Veterans Commission to:
1515 (1) enhance or improve veterans' assistance programs,
1616 including veterans' representation and counseling;
1717 (2) make grants to address veterans' needs, including
1818 expenses for medical care, health care, housing, travel, and items
1919 or services to improve the veterans' morale and welfare; and
2020 (3) administer the fund.
2121 SECTION 2. Sections 434.017(a) and (e), Government Code, as
2222 amended by Chapters 840 (S.B. 1940) and 1385 (S.B. 1655), Acts of
2323 the 81st Legislature, Regular Session, 2009, are reenacted and
2424 amended to read as follows:
2525 (a) The fund for veterans' assistance is a special fund in
2626 the state treasury outside the general revenue fund. The fund is
2727 composed of:
2828 (1) money transferred to the fund at the direction of
2929 the legislature;
3030 (2) gifts and grants contributed to the fund;
3131 (3) the earnings of the fund; [and]
3232 (4) money transferred to the fund from proceeds of the
3333 lottery game operated under Section 466.027 or transferred to the
3434 fund under Section 466.408(b); and
3535 (5) [(2)] money deposited to the credit of the fund
3636 under Section 502.1746, Transportation Code.
3737 (e) To carry out any purpose of this chapter, the commission
3838 [Texas Veterans Commission] may solicit, [and] accept, or refuse a
3939 gift, grant, devise, bequest of money, security, service, or
4040 property, including money raised or a service provided by a
4141 volunteer or volunteer group, to promote the work of the commission
4242 for any purpose related to the fund for veterans' assistance. The
4343 commission may participate in the establishment and operation of an
4444 affiliated nonprofit organization that is established for the
4545 purpose of raising money for or providing services or other
4646 benefits to the commission. A gift, grant, devise, or bequest to the
4747 fund may be appropriated in the same manner as other money in the
4848 fund, subject to the purposes provided by Subsection (c) and any
4949 limitation or requirement placed on the gift, grant, devise, or
5050 bequest by the donor or granting entity.
5151 SECTION 3. This Act takes effect September 1, 2011.
