| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 434.017(c), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (c) Money in the fund may be appropriated to the Texas |
|---|
| 14 | 14 | | Veterans Commission to: |
|---|
| 15 | 15 | | (1) enhance or improve veterans' assistance programs, |
|---|
| 16 | 16 | | including veterans' representation and counseling; |
|---|
| 17 | 17 | | (2) make grants to address veterans' needs, including |
|---|
| 18 | 18 | | expenses for medical care, health care, housing, travel, and items |
|---|
| 19 | 19 | | or services to improve the veterans' morale and welfare; and |
|---|
| 20 | 20 | | (3) administer the fund. |
|---|
| 21 | 21 | | SECTION 2. Sections 434.017(a) and (e), Government Code, as |
|---|
| 22 | 22 | | amended by Chapters 840 (S.B. 1940) and 1385 (S.B. 1655), Acts of |
|---|
| 23 | 23 | | the 81st Legislature, Regular Session, 2009, are reenacted and |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (a) The fund for veterans' assistance is a special fund in |
|---|
| 26 | 26 | | the state treasury outside the general revenue fund. The fund is |
|---|
| 27 | 27 | | composed of: |
|---|
| 28 | 28 | | (1) money transferred to the fund at the direction of |
|---|
| 29 | 29 | | the legislature; |
|---|
| 30 | 30 | | (2) gifts and grants contributed to the fund; |
|---|
| 31 | 31 | | (3) the earnings of the fund; [and] |
|---|
| 32 | 32 | | (4) money transferred to the fund from proceeds of the |
|---|
| 33 | 33 | | lottery game operated under Section 466.027 or transferred to the |
|---|
| 34 | 34 | | fund under Section 466.408(b); and |
|---|
| 35 | 35 | | (5) [(2)] money deposited to the credit of the fund |
|---|
| 36 | 36 | | under Section 502.1746, Transportation Code. |
|---|
| 37 | 37 | | (e) To carry out any purpose of this chapter, the commission |
|---|
| 38 | 38 | | [Texas Veterans Commission] may solicit, [and] accept, or refuse a |
|---|
| 39 | 39 | | gift, grant, devise, bequest of money, security, service, or |
|---|
| 40 | 40 | | property, including money raised or a service provided by a |
|---|
| 41 | 41 | | volunteer or volunteer group, to promote the work of the commission |
|---|
| 42 | 42 | | for any purpose related to the fund for veterans' assistance. The |
|---|
| 43 | 43 | | commission may participate in the establishment and operation of an |
|---|
| 44 | 44 | | affiliated nonprofit organization that is established for the |
|---|
| 45 | 45 | | purpose of raising money for or providing services or other |
|---|
| 46 | 46 | | benefits to the commission. A gift, grant, devise, or bequest to the |
|---|
| 47 | 47 | | fund may be appropriated in the same manner as other money in the |
|---|
| 48 | 48 | | fund, subject to the purposes provided by Subsection (c) and any |
|---|
| 49 | 49 | | limitation or requirement placed on the gift, grant, devise, or |
|---|
| 50 | 50 | | bequest by the donor or granting entity. |
|---|
| 51 | 51 | | SECTION 3. This Act takes effect September 1, 2011. |
