99 AN ACT
1010 relating to the expiration of a county burn ban.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 352.081(e), Local Government Code, is
1313 amended to read as follows:
1414 (e) An order adopted under this section expires, as
1515 applicable, on the date:
1616 (1) a determination is made under Subsection (b) that
1717 drought conditions no longer exist; or
1818 (2) a determination is made by the commissioners
1919 court, or the county judge or fire marshal if designated for that
2020 purpose by the commissioners court, that the circumstances
2121 identified under Subsection (c)(2) no longer exist.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2011.
