11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 352.081(e), Local Government Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (e) An order adopted under this section expires, as |
---|
15 | 15 | | applicable, on the date: |
---|
16 | 16 | | (1) a determination is made under Subsection (b) that |
---|
17 | 17 | | drought conditions no longer exist; or |
---|
18 | 18 | | (2) a determination is made by the commissioners |
---|
19 | 19 | | court, or the county judge or fire marshal if designated for that |
---|
20 | 20 | | purpose by the commissioners court, that the circumstances |
---|
21 | 21 | | identified under Subsection (c)(2) no longer exist. |

22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
---|
23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
---|
24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
---|
26 | 26 | | Act takes effect September 1, 2011. |
