77 relating to a probate fee exemption for estates of certain law
88 enforcement officers, firefighters, and others killed in the line
99 of duty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 ARTICLE 1. TEXAS PROBATE CODE
1212 SECTION 1.01. Chapter I, Texas Probate Code, is amended by
1313 adding Section 11B to read as follows:
1414 Sec. 11B. EXEMPTION FROM PROBATE FEES FOR ESTATES OF
1515 CERTAIN LAW ENFORCEMENT OFFICERS, FIREFIGHTERS, AND OTHERS.
1616 (a) In this section:
1717 (1) "Eligible decedent" means an individual listed in
1818 Section 615.003, Government Code.
1919 (2) "Line of duty" and "personal injury" have the
2020 meanings assigned by Section 615.021(e), Government Code.
2121 (b) Notwithstanding any other law, the clerk of a court may
2222 not charge, or collect from, the estate of an eligible decedent any
2323 of the following fees if the decedent died as a result of a personal
2424 injury sustained in the line of duty in the individual's position as
2525 described by Section 615.003, Government Code:
2626 (1) a fee for or associated with the filing of the
2727 decedent's will for probate; and
2828 (2) a fee for any service rendered by the court
2929 regarding the administration of the decedent's estate.
3030 SECTION 1.02. The changes in law made by this article apply
3131 only to the estate of a decedent who dies on or after the effective
3232 date of this Act. The estate of a decedent who dies before the
3333 effective date of this Act is governed by the law in effect on the
3434 date of the decedent's death, and the former law is continued in
3535 effect for that purpose.
3636 ARTICLE 2. ESTATES CODE
3737 SECTION 2.01. Subchapter B, Chapter 53, Estates Code, is
3838 amended by adding Section 53.054 to read as follows:
3939 Sec. 53.054. EXEMPTION FROM PROBATE FEES FOR ESTATES OF
4040 CERTAIN LAW ENFORCEMENT OFFICERS, FIREFIGHTERS, AND OTHERS.
4141 (a) In this section:
4242 (1) "Eligible decedent" means an individual listed in
4343 Section 615.003, Government Code.
4444 (2) "Line of duty" and "personal injury" have the
4545 meanings assigned by Section 615.021(e), Government Code.
4646 (b) Notwithstanding any other law, the clerk of a court may
4747 not charge, or collect from, the estate of an eligible decedent any
4848 of the following fees if the decedent died as a result of a personal
4949 injury sustained in the line of duty in the individual's position as
5050 described by Section 615.003, Government Code:
5151 (1) a fee for or associated with the filing of the
5252 decedent's will for probate; and
5353 (2) a fee for any service rendered by the court
5454 regarding the administration of the decedent's estate.
5555 SECTION 2.02. Section 11B, Texas Probate Code, as added by
5656 Article 1 of this Act, is repealed.
5757 SECTION 2.03. This article takes effect January 1, 2014.
5858 ARTICLE 3. EFFECTIVE DATE
5959 SECTION 3.01. Except as otherwise provided by this Act,
6060 this Act takes effect September 1, 2011.
