99 AN ACT
1010 relating to the authority of certain counties to impose a county
1111 hotel occupancy tax.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 352.002, Tax Code, is amended by
1414 amending Subsection (a) and adding Subsection (l) to read as
1515 follows:
1616 (a) The commissioners courts of the following counties by
1717 the adoption of an order or resolution may impose a tax on a person
1818 who, under a lease, concession, permit, right of access, license,
1919 contract, or agreement, pays for the use or possession or for the
2020 right to the use or possession of a room that is in a hotel, costs $2
2121 or more each day, and is ordinarily used for sleeping:
2222 (1) a county that has a population of more than 3.3
2323 million;
2424 (2) a county that has a population of 90,000 or more,
2525 borders the United Mexican States, and does not have three or more
2626 cities that each have a population of more than 17,500;
2727 (3) a county in which there is no municipality;
2828 (4) a county in which there is located an Indian
2929 reservation under the jurisdiction of the United States government;
3030 (5) a county that has a population of 30,000 or less,
3131 that has no more than one municipality with a population of less
3232 than 2,500, and that borders two counties located wholly in the
3333 Edwards Aquifer Authority established by Chapter 626, Acts of the
3434 73rd Legislature, Regular Session, 1993;
3535 (6) a county that borders the Gulf of Mexico;
3636 (7) a county that has a population of less than 5,000,
3737 that borders the United Mexican States, and in which there is
3838 located a major observatory;
3939 (8) a county that has a population of 12,000 or less
4040 and borders the Toledo Bend Reservoir;
4141 (9) a county that has a population of less than 12,000
4242 and an area of less than 275 square miles;
4343 (10) a county that has a population of 30,000 or less
4444 and borders Possum Kingdom Lake;
4545 (11) a county that borders the United Mexican States
4646 and has a population of more than 300,000 and less than 600,000;
4747 (12) a county that has a population of 35,000 or more
4848 and borders or contains a portion of Lake Fork Reservoir;
4949 (13) a county that borders the United Mexican States
5050 and in which there is located a national recreation area;
5151 (14) a county that borders the United Mexican States
5252 and in which there is located a national park of more than 400,000
5353 acres;
5454 (15) a county that has a population of 28,000 or less,
5555 that has no more than four municipalities, and that is located
5656 wholly in the Edwards Aquifer Authority established by Chapter 626,
5757 Acts of the 73rd Legislature, Regular Session, 1993;
5858 (16) a county that has a population of 25,000 or less,
5959 whose territory is less than 750 square miles, and that has two
6060 incorporated municipalities, each with a population of 800 or less,
6161 located on the Frio River;
6262 (17) a county that has a population of 34,000 or more
6363 and borders Lake Buchanan;
6464 (18) a county that has a population of more than 45,000
6565 and less than 75,000, that borders the United Mexican States, and
6666 that borders or contains a portion of Falcon Lake;
6767 (19) a county with a population of 21,000 or less that
6868 borders the Neches River and in which there is located a national
6969 preserve;
7070 (20) a county that has a population of 22,500 or less
7171 and that borders or contains a portion of Lake Livingston;
7272 (21) a county through which the Pedernales River flows
7373 [that has a population of less than 22,000] and in which the
7474 birthplace of a president of the United States is located;
7575 (22) a county that has a population of more than 15,000
7676 but less than 20,000 and borders Lake Buchanan;
7777 (23) a county with a population of less than 10,000
7878 that is bordered by the Sulphur River;
7979 (24) a county that has a population of 16,000 or more
8080 and borders the entire north shore of Lake Somerville;
8181 (25) a county that has a population of 20,000 or less
8282 and that is bordered by the Brazos and Navasota Rivers;
8383 (26) a county that has a population of more than 15,000
8484 and less than 25,000 and is located on the Trinity and Navasota
8585 Rivers;
8686 (27) a county that has a population of less than 15,000
8787 and that is bordered by the Trinity and Navasota Rivers;
8888 (28) a county that borders or contains a portion of the
8989 Neches River, the Sabine River, and Sabine Lake; and
9090 (29) a county that borders Whitney Lake.
9191 (l) The commissioners court of a county through which the
9292 Guadalupe River flows and in which the source of the Blanco River is
9393 located may impose a tax as provided by Subsection (a). A tax
9494 imposed under this subsection does not apply to a hotel located in a
9595 municipality that imposes a tax under Chapter 351 applicable to the
9696 hotel.
9797 SECTION 2. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2011.
