10	10	AN ACT
11	11	relating to the transfer of certain state property from the Texas
12	12	Department of Transportation to the Parks and Wildlife Department.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. (a) Not later than December 31, 2011, the Texas
15	15	Department of Transportation shall transfer to the Parks and
16	16	Wildlife Department the real property described by Subsection (d)
17	17	of this section.
18	18	(b) The consideration for the transfer authorized by
19	19	Subsection (a) of this section is the requirement that the Parks and
20	20	Wildlife Department use the property transferred only for a public
21	21	park, a purpose that benefits the public interest of the state. If
22	22	the Parks and Wildlife Department no longer uses the property for a
23	23	public park, ownership of the property automatically reverts to the
24	24	Texas Department of Transportation.
25	25	(c) The Texas Department of Transportation shall transfer
26	26	the property by an appropriate instrument of transfer, executed on
27	27	its behalf by the commissioner of the General Land Office. The
28	28	instrument of transfer must:
29	29	(1) include a provision that:
30	30	(A) requires the Parks and Wildlife Department to
31	31	use the property for a public park, a purpose that benefits the
32	32	public interest of the state;
33	33	(B) allows the Parks and Wildlife Department to
34	34	lease the property described by Subsection (d) to the Williamson
35	35	County Parks and Recreation Department for use as a public park; and
36	36	(C) indicates that ownership of the property
37	37	automatically reverts to the Texas Department of Transportation if
38	38	the Parks and Wildlife Department no longer uses the property for a
39	39	public park; and
40	40	(2) describe the property to be transferred by metes
41	41	and bounds.
42	42	(d) The real property to which Subsection (a) of this
43	43	section refers is described as follows:
44	44	A tract of land situated in the Damon Survey, Abstract No. 170, in
45	45	Williamson County, Texas, being all of that called 6.180 acre tract
46	46	of land (Tract 7), as shown on that unrecorded plat prepared by KC
47	47	Engineering dated July 18, 1994, on ten (10) tracts of land out of
48	48	that called 780.508 acre tract of land conveyed to the State of
49	49	Texas, State Department of Highways and Public Transportation, by
50	50	instrument recorded in Volume 1723, Page 855, of the Official
51	51	Records of Williamson County, Texas.
52	52	SECTION 2. This Act takes effect immediately if it receives
53	53	a vote of two-thirds of all the members elected to each house, as
54	54	provided by Section 39, Article III, Texas Constitution. If this
55	55	Act does not receive the vote necessary for immediate effect, this
56	56	Act takes effect September 1, 2011.
