88 relating to a study of the practice of advanced practice registered
99 nurses and the authority of those nurses to prescribe and order
1010 prescription drugs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. INTERIM STUDY OF INDEPENDENT PRACTICE OF
1313 ADVANCED PRACTICE REGISTERED NURSES. (a) The speaker of the house
1414 of representatives and the lieutenant governor shall issue a joint
1515 interim charge to the standing committees of the house of
1616 representatives and senate with jurisdiction over health care
1717 professionals to conduct a joint study as described by Subsection
1818 (b).
1919 (b) The study shall examine the independent practice of
2020 advanced practice registered nurses to perform basic emergency and
2121 non-emergency health care services and preventive health care
2222 services within the scope of the health care providers' practice
2323 and license, including:
2424 (1) the potential cost savings of health care
2525 providers who are not physicians performing these health care
2626 services;
2727 (2) the impact on access to health care services for
2828 underserved communities and health professional shortage areas;
2929 (3) any projected impact on patient safety and the
3030 quality of care for persons treated by health care providers who are
3131 not physicians;
3232 (4) the effect on the state's overall health care
3333 system; and
3434 (5) the potential cost savings and other foreseeable
3535 consequences of expanding the authority of advanced practice
3636 registered nurses to prescribe medication to patients.
3737 (c) Not later than January 1, 2013, the committees shall
3838 report the committees' findings and recommendations to the
3939 lieutenant governor, the speaker of the house of representatives,
4040 and the governor. The committees shall include in their
4141 recommendations specific changes to statutes and agency rules that
4242 may be necessary according to the results of the committees' study
4343 conducted under this section.
4444 (d) Not later than November 1, 2011, the lieutenant governor
4545 and the speaker of the house of representatives shall issue the
4646 joint interim charge required by this section.
4747 (e) This section expires January 1, 2013.
4848 SECTION 2. EFFECTIVE DATE. This Act takes effect September
4949 1, 2011.
