9 | 9 | | nurses and the authority of those nurses to prescribe and order |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. INTERIM STUDY OF INDEPENDENT PRACTICE OF |
---|
13 | 13 | | ADVANCED PRACTICE REGISTERED NURSES. (a) The speaker of the house |
---|
14 | 14 | | of representatives and the lieutenant governor shall issue a joint |
---|
15 | 15 | | interim charge to the standing committees of the house of |
---|
16 | 16 | | representatives and senate with jurisdiction over health care |
---|
17 | 17 | | professionals to conduct a joint study as described by Subsection |
---|
18 | 18 | | (b). |
---|
19 | 19 | | (b) The study shall examine the independent practice of |
---|
20 | 20 | | advanced practice registered nurses to perform basic emergency and |
---|
21 | 21 | | non-emergency health care services and preventive health care |
---|
22 | 22 | | services within the scope of the health care providers' practice |
---|
23 | 23 | | and license, including: |
---|
24 | 24 | | (1) the potential cost savings of health care |
---|
25 | 25 | | providers who are not physicians performing these health care |
---|
26 | 26 | | services; |
---|
27 | 27 | | (2) the impact on access to health care services for |
---|
28 | 28 | | underserved communities and health professional shortage areas; |
---|
29 | 29 | | (3) any projected impact on patient safety and the |
---|
30 | 30 | | quality of care for persons treated by health care providers who are |
---|
31 | 31 | | not physicians; |
---|
32 | 32 | | (4) the effect on the state's overall health care |
---|
33 | 33 | | system; and |
---|
34 | 34 | | (5) the potential cost savings and other foreseeable |
---|
35 | 35 | | consequences of expanding the authority of advanced practice |
---|
36 | 36 | | registered nurses to prescribe medication to patients. |
---|
37 | 37 | | (c) Not later than January 1, 2013, the committees shall |
---|
38 | 38 | | report the committees' findings and recommendations to the |
---|
39 | 39 | | lieutenant governor, the speaker of the house of representatives, |
---|
40 | 40 | | and the governor. The committees shall include in their |
---|
41 | 41 | | recommendations specific changes to statutes and agency rules that |
---|
42 | 42 | | may be necessary according to the results of the committees' study |
---|
43 | 43 | | conducted under this section. |
---|
44 | 44 | | (d) Not later than November 1, 2011, the lieutenant governor |
---|
45 | 45 | | and the speaker of the house of representatives shall issue the |
---|
46 | 46 | | joint interim charge required by this section. |
---|
47 | 47 | | (e) This section expires January 1, 2013. |
---|
48 | 48 | | SECTION 2. EFFECTIVE DATE. This Act takes effect September |
---|
49 | 49 | | 1, 2011. |
