| 7 | 7 | | relating to a person's eligibility for appointment as a volunteer |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 13.031(d), Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (d) To be eligible for appointment as a volunteer deputy |
|---|
| 13 | 13 | | registrar, a person must: |
|---|
| 14 | 14 | | (1) be a registered voter [18 years of age or older]; |
|---|
| 15 | 15 | | [and] |
|---|
| 16 | 16 | | (2) not have been finally convicted of a felony or, if |
|---|
| 17 | 17 | | so convicted, must have: |
|---|
| 18 | 18 | | (A) fully discharged the person's sentence, |
|---|
| 19 | 19 | | including any term of incarceration, parole, or supervision, or |
|---|
| 20 | 20 | | completed a period of probation ordered by any court; or |
|---|
| 21 | 21 | | (B) been pardoned or otherwise released from the |
|---|
| 22 | 22 | | resulting disability to vote; and |
|---|
| 23 | 23 | | (3) not have been finally convicted of an offense |
|---|
| 24 | 24 | | under Section 32.51, Penal Code. |
|---|
| 25 | 25 | | SECTION 2. Section 13.033(b), Election Code, is amended to |
|---|
| 26 | 26 | | read as follows: |
|---|
| 27 | 27 | | (b) If a person is to be appointed, the registrar shall |
|---|
| 28 | 28 | | prepare a certificate of appointment in duplicate containing: |
|---|
| 29 | 29 | | (1) the date of appointment; |
|---|
| 30 | 30 | | (2) the statement: "I, _____________, Voter Registrar |
|---|
| 31 | 31 | | for _____________ County, do hereby appoint _______________ as a |
|---|
| 32 | 32 | | volunteer deputy registrar for _____________ County."; |
|---|
| 33 | 33 | | (3) the person's residence address; |
|---|
| 34 | 34 | | (4) the person's voter registration number, if any; |
|---|
| 35 | 35 | | (5) a statement that the term of the appointment |
|---|
| 36 | 36 | | expires December 31 of an even-numbered year; and |
|---|
| 37 | 37 | | (6) a statement that the appointment: |
|---|
| 38 | 38 | | (A) terminates on the person's final conviction |
|---|
| 39 | 39 | | for an offense: |
|---|
| 40 | 40 | | (i) for failure to deliver a registration |
|---|
| 41 | 41 | | application; or |
|---|
| 42 | 42 | | (ii) under Section 32.51, Penal Code; and |
|---|
| 43 | 43 | | (B) may terminate on the registrar's |
|---|
| 44 | 44 | | determination that the person failed to adequately review a |
|---|
| 45 | 45 | | registration application. |
|---|
| 46 | 46 | | SECTION 3. Section 13.036(a), Election Code, is amended to |
|---|
| 47 | 47 | | read as follows: |
|---|
| 48 | 48 | | (a) An appointment as a volunteer deputy registrar is |
|---|
| 49 | 49 | | terminated on: |
|---|
| 50 | 50 | | (1) the expiration of the volunteer deputy's term of |
|---|
| 51 | 51 | | appointment; or |
|---|
| 52 | 52 | | (2) the final conviction of the volunteer deputy for |
|---|
| 53 | 53 | | an offense prescribed by Section 13.043 of this code or Section |
|---|
| 54 | 54 | | 32.51, Penal Code. |
|---|
| 55 | 55 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 56 | 56 | | to the appointment of a volunteer deputy voter registrar on or after |
|---|
| 57 | 57 | | the effective date of this Act. The appointment of a volunteer |
|---|
| 58 | 58 | | deputy voter registrar before the effective date of this Act is |
|---|
| 59 | 59 | | governed by the law in effect when the registrar was appointed, and |
|---|
| 60 | 60 | | the former law is continued in effect for that purpose. |
|---|
| 61 | 61 | | SECTION 5. This Act takes effect September 1, 2011. |
