| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 547.606, Transportation Code, is amended |
|---|
| 15 | 15 | | by amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 16 | 16 | | follows: |
|---|
| 17 | 17 | | (a) A road tractor, truck, trailer, truck-tractor in |
|---|
| 18 | 18 | | combination with a semitrailer, or semitrailer in combination with |
|---|
| 19 | 19 | | a towing vehicle that has at least four tires or at least two super |
|---|
| 20 | 20 | | single tires on the rearmost axle of the vehicle or the rearmost |
|---|
| 21 | 21 | | vehicle in the combination shall be equipped with safety guards or |
|---|
| 22 | 22 | | flaps that: |
|---|
| 23 | 23 | | (1) are of a type prescribed by the department; and |
|---|
| 24 | 24 | | (2) are located and suspended behind the rearmost |
|---|
| 25 | 25 | | wheels of the vehicle or the rearmost vehicle in the combination |
|---|
| 26 | 26 | | within eight inches of the surface of the highway. |
|---|
| 27 | 27 | | (c) In this section, "super single tire" means a wide-base, |
|---|
| 28 | 28 | | single tire that may be used in place of two standard tires on the |
|---|
| 29 | 29 | | same axle. |
|---|
