77 relating to the student fees for the university center at
88 Midwestern State University.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.518, Education Code, is amended by
1111 amending Subsections (a) and (b) and adding Subsection (d) to read
1212 as follows:
1313 (a) To the extent approved by the students under Subsection
1414 (b) [of this section], the Board of Regents of Midwestern State
1515 University is hereby authorized to levy a regular, fixed student
1616 fee not to exceed, except as authorized under Subsection (d), $15
1717 per student for each semester of the long session and not to exceed
1818 $7.50 per student for all or part of each term of the summer session
1919 for the purpose of operating, maintaining, improving, equipping,
2020 and financing the university center and acquiring or constructing
2121 additions to the center. The amount of the fee may be changed at any
2222 time within the limits specified by this subsection in order to
2323 provide sufficient funds to support the university center. The
2424 fees authorized in this section supplement any other use or service
2525 fee authorized by law.
2626 (b) The decision to levy such a fee, the amount of the
2727 initial fee, and any increase in the fee within the limits specified
2828 by Subsection (a) must be approved by a majority vote of those
2929 students participating in a general election called for that
3030 purpose.
3131 (d) The board may increase the amount of the fee for a
3232 semester or summer session in excess of the applicable amount
3333 provided by Subsection (a) if the increase is approved by a majority
3434 vote of those students participating in a general election called
3535 for that purpose. The increased amount under this subsection may
3636 not be charged after the fifth academic year in which the increased
3737 amount is first charged unless, before the end of that academic
3838 year, the institution has issued bonds payable from the fee, in
3939 which event the increased amount may not be charged after the
4040 academic year in which all such bonds, including refunding bonds
4141 for those bonds, have been fully paid.
4242 SECTION 2. The change in law made by this Act applies only
4343 to fees imposed for a semester or term that begins on or after the
4444 effective date of this Act.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2011.
