| 8 | 8 | | Midwestern State University. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 54.518, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsections (a) and (b) and adding Subsection (d) to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | (a) To the extent approved by the students under Subsection |
|---|
| 14 | 14 | | (b) [of this section], the Board of Regents of Midwestern State |
|---|
| 15 | 15 | | University is hereby authorized to levy a regular, fixed student |
|---|
| 16 | 16 | | fee not to exceed, except as authorized under Subsection (d), $15 |
|---|
| 17 | 17 | | per student for each semester of the long session and not to exceed |
|---|
| 18 | 18 | | $7.50 per student for all or part of each term of the summer session |
|---|
| 19 | 19 | | for the purpose of operating, maintaining, improving, equipping, |
|---|
| 20 | 20 | | and financing the university center and acquiring or constructing |
|---|
| 21 | 21 | | additions to the center. The amount of the fee may be changed at any |
|---|
| 22 | 22 | | time within the limits specified by this subsection in order to |
|---|
| 23 | 23 | | provide sufficient funds to support the university center. The |
|---|
| 24 | 24 | | fees authorized in this section supplement any other use or service |
|---|
| 25 | 25 | | fee authorized by law. |
|---|
| 26 | 26 | | (b) The decision to levy such a fee, the amount of the |
|---|
| 27 | 27 | | initial fee, and any increase in the fee within the limits specified |
|---|
| 28 | 28 | | by Subsection (a) must be approved by a majority vote of those |
|---|
| 29 | 29 | | students participating in a general election called for that |
|---|
| 30 | 30 | | purpose. |
|---|
| 31 | 31 | | (d) The board may increase the amount of the fee for a |
|---|
| 32 | 32 | | semester or summer session in excess of the applicable amount |
|---|
| 33 | 33 | | provided by Subsection (a) if the increase is approved by a majority |
|---|
| 34 | 34 | | vote of those students participating in a general election called |
|---|
| 35 | 35 | | for that purpose. The increased amount under this subsection may |
|---|
| 36 | 36 | | not be charged after the fifth academic year in which the increased |
|---|
| 37 | 37 | | amount is first charged unless, before the end of that academic |
|---|
| 38 | 38 | | year, the institution has issued bonds payable from the fee, in |
|---|
| 39 | 39 | | which event the increased amount may not be charged after the |
|---|
| 40 | 40 | | academic year in which all such bonds, including refunding bonds |
|---|
| 41 | 41 | | for those bonds, have been fully paid. |
|---|
| 42 | 42 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 43 | 43 | | to fees imposed for a semester or term that begins on or after the |
|---|
| 44 | 44 | | effective date of this Act. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2011. |
