66 AN ACT
77 relating to the statute of limitations on prosecution of the
88 offenses of kidnapping and aggravated kidnapping of a minor.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 12.01, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1313 felony indictments may be presented within these limits, and not
1414 afterward:
1515 (1) no limitation:
1616 (A) murder and manslaughter;
1717 (B) sexual assault under Section 22.011(a)(2),
1818 Penal Code, or aggravated sexual assault under Section
1919 22.021(a)(1)(B), Penal Code;
2020 (C) sexual assault, if during the investigation
2121 of the offense biological matter is collected and subjected to
2222 forensic DNA testing and the testing results show that the matter
2323 does not match the victim or any other person whose identity is
2424 readily ascertained;
2525 (D) continuous sexual abuse of young child or
2626 children under Section 21.02, Penal Code;
2727 (E) indecency with a child under Section 21.11,
2828 Penal Code; or
2929 (F) an offense involving leaving the scene of an
3030 accident under Section 550.021, Transportation Code, if the
3131 accident resulted in the death of a person;
3232 (2) ten years from the date of the commission of the
3333 offense:
3434 (A) theft of any estate, real, personal or mixed,
3535 by an executor, administrator, guardian or trustee, with intent to
3636 defraud any creditor, heir, legatee, ward, distributee,
3737 beneficiary or settlor of a trust interested in such estate;
3838 (B) theft by a public servant of government
3939 property over which he exercises control in his official capacity;
4040 (C) forgery or the uttering, using or passing of
4141 forged instruments;
4242 (D) injury to an elderly or disabled individual
4343 punishable as a felony of the first degree under Section 22.04,
4444 Penal Code;
4545 (E) sexual assault, except as provided by
4646 Subdivision (1); or
4747 (F) arson;
4848 (3) seven years from the date of the commission of the
4949 offense:
5050 (A) misapplication of fiduciary property or
5151 property of a financial institution;
5252 (B) securing execution of document by deception;
5353 (C) a felony violation under Chapter 162, Tax
5454 Code;
5555 (D) false statement to obtain property or credit
5656 under Section 32.32, Penal Code;
5757 (E) money laundering;
5858 (F) credit card or debit card abuse under Section
5959 32.31, Penal Code; or
6060 (G) fraudulent use or possession of identifying
6161 information under Section 32.51, Penal Code;
6262 (4) five years from the date of the commission of the
6363 offense:
6464 (A) theft or robbery;
6565 (B) except as provided by Subdivision (5),
6666 kidnapping or burglary;
6767 (C) injury to an elderly or disabled individual
6868 that is not punishable as a felony of the first degree under Section
6969 22.04, Penal Code;
7070 (D) abandoning or endangering a child; or
7171 (E) insurance fraud;
7272 (5) if the investigation of the offense shows that the
7373 victim is younger than 17 years of age at the time the offense is
7474 committed, 20 years from the 18th birthday of the victim of one of
7575 the following offenses:
7676 (A) sexual performance by a child under Section
7777 43.25, Penal Code;
7878 (B) kidnapping under Section 20.03, Penal Code,
7979 or aggravated kidnapping under Section 20.04 [20.04(a)(4)], Penal
8080 Code[, if the defendant committed the offense with the intent to
8181 violate or abuse the victim sexually]; or
8282 (C) burglary under Section 30.02, Penal Code, if
8383 the offense is punishable under Subsection (d) of that section and
8484 the defendant committed the offense with the intent to commit an
8585 offense described by Subdivision (1)(B) or (D) of this article or
8686 Paragraph (B) of this subdivision;
8787 (6) ten years from the 18th birthday of the victim of
8888 the offense: injury to a child under Section 22.04, Penal Code; or
8989 (7) three years from the date of the commission of the
9090 offense: all other felonies.
9191 SECTION 2. The change in law made by this Act does not apply
9292 to an offense if the prosecution of that offense becomes barred by
9393 limitation before the effective date of this Act. The prosecution
9494 of that offense remains barred as if this Act had not taken effect.
9595 SECTION 3. This Act takes effect September 1, 2011.
