7 | 7 | | relating to requiring flashing lights to be posted before an |
---|
8 | 8 | | intersection at which a photographic system is used to enforce |
---|
9 | 9 | | compliance with traffic-control signals. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Section 544.012(c), Transportation Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (c) The municipality shall install signs along each roadway |
---|
14 | 14 | | that leads to an intersection at which a photographic traffic |
---|
15 | 15 | | monitoring system is in active use. Each sign [The signs] must: |
---|
16 | 16 | | (1) be located at least 100 feet but not more than 750 |
---|
17 | 17 | | feet from the intersection in accordance with the [or located |
---|
18 | 18 | | according to] standards established in the manual adopted by the |
---|
19 | 19 | | Texas Transportation Commission under Section 544.001; |
---|
20 | 20 | | (2) [,] be easily readable to any operator approaching |
---|
21 | 21 | | the intersection; |
---|
22 | 22 | | (3) have affixed a flashing yellow circular beacon; |
---|
23 | 23 | | (4) [, and] clearly indicate the presence of a |
---|
24 | 24 | | photographic monitoring system that records violations that may |
---|
25 | 25 | | result in the issuance of a notice of violation and the imposition |
---|
26 | 26 | | of a monetary penalty; and |
---|
27 | 27 | | (5) comply with design and size requirements |
---|
28 | 28 | | established by the Texas Department of Transportation. |
---|
29 | 29 | | SECTION 2. Section 707.003(g), Transportation Code, is |
---|
30 | 30 | | amended to read as follows: |
---|
31 | 31 | | (g) The local authority shall install signs along each |
---|
32 | 32 | | roadway that leads to an intersection at which a photographic |
---|
33 | 33 | | traffic signal enforcement system is in active use. Each sign [The |
---|
34 | 34 | | signs] must: |
---|
35 | 35 | | (1) be located at least 100 feet but not more than 750 |

48 | 48 | | SECTION 3. (a) The changes in law made by this Act apply |
---|
49 | 49 | | only to a sign that indicates the presence of a photographic |
---|
50 | 50 | | monitoring system or a photographic traffic signal enforcement |
---|
51 | 51 | | system and is installed on or after the effective date of this Act. |
---|
52 | 52 | | (b) A municipality or a local authority, as defined by |
---|
53 | 53 | | Section 541.002, Transportation Code, shall ensure that a sign that |
---|
54 | 54 | | indicates the presence of a photographic monitoring system or a |
---|
55 | 55 | | photographic traffic signal enforcement system and was installed by |
---|
56 | 56 | | the municipality or local authority before the effective date of |
---|
57 | 57 | | this Act complies with this Act not later than September 1, 2012. |
---|
58 | 58 | | SECTION 4. This Act takes effect September 1, 2011. |
