77 relating to requiring flashing lights to be posted before an
88 intersection at which a photographic system is used to enforce
99 compliance with traffic-control signals.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 544.012(c), Transportation Code, is
1212 amended to read as follows:
1313 (c) The municipality shall install signs along each roadway
1414 that leads to an intersection at which a photographic traffic
1515 monitoring system is in active use. Each sign [The signs] must:
1616 (1) be located at least 100 feet but not more than 750
1717 feet from the intersection in accordance with the [or located
1818 according to] standards established in the manual adopted by the
1919 Texas Transportation Commission under Section 544.001;
2020 (2) [,] be easily readable to any operator approaching
2121 the intersection;
2222 (3) have affixed a flashing yellow circular beacon;
2323 (4) [, and] clearly indicate the presence of a
2424 photographic monitoring system that records violations that may
2525 result in the issuance of a notice of violation and the imposition
2626 of a monetary penalty; and
2727 (5) comply with design and size requirements
2828 established by the Texas Department of Transportation.
2929 SECTION 2. Section 707.003(g), Transportation Code, is
3030 amended to read as follows:
3131 (g) The local authority shall install signs along each
3232 roadway that leads to an intersection at which a photographic
3333 traffic signal enforcement system is in active use. Each sign [The
3434 signs] must:
3535 (1) be located at least 100 feet but not more than 750
3636 feet from the intersection in accordance with the [or located
3737 according to] standards established in the manual adopted by the
3838 Texas Transportation Commission under Section 544.001;
3939 (2) [,] be easily readable to any operator approaching
4040 the intersection;
4141 (3) have affixed a flashing yellow circular beacon;
4242 (4) [, and] clearly indicate the presence of a
4343 photographic traffic signal enforcement [photographic monitoring]
4444 system that records violations that may result in the issuance of a
4545 notice of violation and the imposition of a monetary penalty; and
4646 (5) comply with design and size requirements
4747 established by the Texas Department of Transportation.
4848 SECTION 3. (a) The changes in law made by this Act apply
4949 only to a sign that indicates the presence of a photographic
5050 monitoring system or a photographic traffic signal enforcement
5151 system and is installed on or after the effective date of this Act.
5252 (b) A municipality or a local authority, as defined by
5353 Section 541.002, Transportation Code, shall ensure that a sign that
5454 indicates the presence of a photographic monitoring system or a
5555 photographic traffic signal enforcement system and was installed by
5656 the municipality or local authority before the effective date of
5757 this Act complies with this Act not later than September 1, 2012.
5858 SECTION 4. This Act takes effect September 1, 2011.
