13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 683.071, Transportation Code, is amended |
---|
15 | 15 | | to read as follows: |
---|
16 | 16 | | Sec. 683.071. DEFINITION. In this subchapter, "junked |
---|
17 | 17 | | vehicle" means a vehicle that is self-propelled and: |
---|
18 | 18 | | (1) displays an expired license plate or invalid motor |
---|
19 | 19 | | vehicle inspection certificate or does not display a license plate |
---|
20 | 20 | | or motor vehicle inspection certificate; and [have lawfully |
---|
21 | 21 | | attached to it: |
---|
22 | 22 | | [(A) an unexpired license plate; and |
---|
23 | 23 | | [(B) a valid motor vehicle inspection |
---|
24 | 24 | | certificate; and] |
---|
25 | 25 | | (2) is: |
---|
26 | 26 | | (A) wrecked, dismantled or partially dismantled, |
---|
27 | 27 | | or discarded; or |
---|
28 | 28 | | (B) inoperable and has remained inoperable for |
---|
29 | 29 | | more than: |
---|
30 | 30 | | (i) 72 consecutive hours, if the vehicle is |
---|
31 | 31 | | on public property; or |
---|
32 | 32 | | (ii) 30 consecutive days, if the vehicle is |
---|
33 | 33 | | on private property. |
---|
34 | 34 | | SECTION 2. This Act takes effect September 1, 2011. |
