99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the definition of a junked vehicle for purposes of
1212 abatement of a public nuisance.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 683.071, Transportation Code, is amended
1515 to read as follows:
1616 Sec. 683.071. DEFINITION. In this subchapter, "junked
1717 vehicle" means a vehicle that is self-propelled and:
1818 (1) displays an expired license plate or invalid motor
1919 vehicle inspection certificate or does not display a license plate
2020 or motor vehicle inspection certificate; and [have lawfully
2121 attached to it:
2222 [(A) an unexpired license plate; and
2323 [(B) a valid motor vehicle inspection
2424 certificate; and]
2525 (2) is:
2626 (A) wrecked, dismantled or partially dismantled,
2727 or discarded; or
2828 (B) inoperable and has remained inoperable for
2929 more than:
3030 (i) 72 consecutive hours, if the vehicle is
3131 on public property; or
3232 (ii) 30 consecutive days, if the vehicle is
3333 on private property.
3434 SECTION 2. This Act takes effect September 1, 2011.
