99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the purchasing of a firearm from the county by an
1212 honorably retired law enforcement officer.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 170, Local Government Code, is amended
1515 by adding Section 170.002 to read as follows:
1616 Sec. 170.002. PURCHASE OF FIREARM BY HONORABLY RETIRED LAW
1717 ENFORCEMENT OFFICER. (a) An individual may purchase a firearm from
1818 a county if:
1919 (1) the individual was a peace officer commissioned by
2020 the county who is honorably retired;
2121 (2) the firearm had been previously issued to the
2222 individual by the county; and
2323 (3) the firearm is not a prohibited weapon under
2424 Section 46.05, Penal Code.
2525 (b) An individual may purchase only one firearm from a
2626 county under this section.
2727 (c) The county commissioners court shall establish the
2828 amount, which may not exceed fair market value, for which a firearm
2929 may be purchased under this section.
3030 SECTION 2. This Act takes effect September 1, 2011.
