66 AN ACT
77 relating to the authority of the Childress County Hospital District
88 to provide facilities and services for persons who are elderly or
99 disabled; providing authority to issue bonds and notes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 1012, Special District
1212 Local Laws Code, is amended by adding Section 1012.114 to read as
1313 follows:
1414 Sec. 1012.114. FACILITIES OR SERVICES FOR PERSONS WHO ARE
1515 ELDERLY OR DISABLED. (a) The district may:
1616 (1) purchase, construct, acquire, repair, renovate,
1717 equip, or administer the following types of facilities or services
1818 for the care of persons who are elderly or disabled:
1919 (A) a nursing home or similar long-term care
2020 facility;
2121 (B) elderly housing;
2222 (C) assisted living;
2323 (D) home health;
2424 (E) personal care;
2525 (F) special care; or
2626 (G) continuing care; and
2727 (2) purchase, acquire, repair, or equip durable
2828 medical equipment to provide services to persons who are elderly or
2929 disabled.
3030 (b) For a facility or service described by Subsection (a),
3131 the board may:
3232 (1) lease or enter into an operating or management
3333 agreement relating to all or part of a facility or service that is
3434 owned by the district;
3535 (2) close, transfer, sell, or otherwise convey all or
3636 part of a facility; and
3737 (3) discontinue all or part of a service.
3838 (c) The board may issue general obligation bonds, revenue
3939 bonds, and other notes to acquire, construct, or improve a facility
4040 for the care of persons who are elderly or disabled or to implement
4141 the delivery of a service for the care of persons who are elderly or
4242 disabled.
4343 (d) For the purposes of this section, a facility or service
4444 described by Subsection (a) is a hospital project under Chapter
4545 223, Health and Safety Code, notwithstanding Section 223.002 of
4646 that chapter.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2011.
