| 8 | 8 | | to provide facilities and services for persons who are elderly or |

| 9 | 9 | | disabled; providing authority to issue bonds and notes. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Subchapter C, Chapter 1012, Special District |
|---|
| 12 | 12 | | Local Laws Code, is amended by adding Section 1012.114 to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | Sec. 1012.114. FACILITIES OR SERVICES FOR PERSONS WHO ARE |
|---|
| 15 | 15 | | ELDERLY OR DISABLED. (a) The district may: |
|---|
| 16 | 16 | | (1) purchase, construct, acquire, repair, renovate, |
|---|
| 17 | 17 | | equip, or administer the following types of facilities or services |
|---|
| 18 | 18 | | for the care of persons who are elderly or disabled: |
|---|
| 19 | 19 | | (A) a nursing home or similar long-term care |
|---|
| 20 | 20 | | facility; |
|---|
| 21 | 21 | | (B) elderly housing; |
|---|
| 22 | 22 | | (C) assisted living; |
|---|
| 23 | 23 | | (D) home health; |
|---|
| 24 | 24 | | (E) personal care; |
|---|
| 25 | 25 | | (F) special care; or |
|---|
| 26 | 26 | | (G) continuing care; and |
|---|
| 27 | 27 | | (2) purchase, acquire, repair, or equip durable |
|---|
| 28 | 28 | | medical equipment to provide services to persons who are elderly or |
|---|
| 29 | 29 | | disabled. |
|---|
| 30 | 30 | | (b) For a facility or service described by Subsection (a), |
|---|
| 31 | 31 | | the board may: |
|---|
| 32 | 32 | | (1) lease or enter into an operating or management |
|---|
| 33 | 33 | | agreement relating to all or part of a facility or service that is |
|---|
| 34 | 34 | | owned by the district; |
|---|
| 35 | 35 | | (2) close, transfer, sell, or otherwise convey all or |
|---|
| 36 | 36 | | part of a facility; and |
|---|
| 37 | 37 | | (3) discontinue all or part of a service. |
|---|
| 38 | 38 | | (c) The board may issue general obligation bonds, revenue |
|---|
| 39 | 39 | | bonds, and other notes to acquire, construct, or improve a facility |
|---|
| 40 | 40 | | for the care of persons who are elderly or disabled or to implement |
|---|
| 41 | 41 | | the delivery of a service for the care of persons who are elderly or |
|---|
| 42 | 42 | | disabled. |
|---|
| 43 | 43 | | (d) For the purposes of this section, a facility or service |
|---|
| 44 | 44 | | described by Subsection (a) is a hospital project under Chapter |
|---|
| 45 | 45 | | 223, Health and Safety Code, notwithstanding Section 223.002 of |
|---|
| 46 | 46 | | that chapter. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2011. |
