7	7	relating to the approval of designs, plans, and specifications of
8	8	industrialized housing and buildings.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1202.155, Occupations Code, is amended
11	11	by adding Subsection (c) to read as follows:
12	12	(c) Notwithstanding Subsections (a) and (b), the commission
13	13	by rule may adopt another method of indicating that the designs,
14	14	plans, and specifications of industrialized housing and buildings
15	15	satisfy the requirements of Subsection (a)(1) and are approved in
16	16	accordance with Subsection (a)(2) if the study conducted under
17	17	Section 1202.1551 recommends the method.
18	18	SECTION 2. Subchapter D, Chapter 1202, Occupations Code, is
19	19	amended by adding Section 1202.1551 to read as follows:
20	20	Sec. 1202.1551. STUDY CONCERNING APPROVAL OF DESIGNS,
21	21	PLANS, AND SPECIFICATIONS. (a) The council shall conduct a study
22	22	to:
23	23	(1) evaluate the current method of indicating approval
24	24	of designs, plans, and specifications of industrialized housing and
25	25	buildings under Sections 1202.155(a) and (b); and
26	26	(2) identify and evaluate methods of indicating
27	27	approval of designs, plans, and specifications of industrialized
28	28	housing and buildings that are alternatives to the method described
29	29	by Subdivision (1).
30	30	(b) The study may recommend for adoption by the commission
31	31	an alternative method identified under Subsection (a)(2) if the
32	32	council determines that the method would:
33	33	(1) ensure that the designs, plans, and specifications
34	34	of industrialized housing and buildings:
35	35	(A) meet or exceed the code standards and
36	36	requirements under council interpretations and instructions; and
37	37	(B) are approved by the department or an approved
38	38	design review agency; and
39	39	(2) be more efficient and cost-effective for the
40	40	department or approved design review agencies.
41	41	(c) This section expires September 1, 2014.
42	42	SECTION 3. Section 1202.252(a), Occupations Code, is
43	43	amended to read as follows:
44	44	(a) A municipality that regulates the on-site construction
45	45	or installation of industrialized housing and buildings may:
46	46	(1) require and review, for compliance with mandatory
47	47	building codes, a complete set of designs, plans, and
48	48	specifications approved by the council [bearing the council's stamp
49	49	of approval] for each installation of industrialized housing or
50	50	buildings in the municipality;
51	51	(2) require that all applicable local permits and
52	52	licenses be obtained before construction begins on a building site;
53	53	(3) require, in accordance with commission rules, that
54	54	all modules or modular components bear an approved decal or
55	55	insignia indicating inspection by the department; and
56	56	(4) establish procedures for the inspection of:
57	57	(A) the erection and installation of
58	58	industrialized housing or buildings to be located in the
59	59	municipality, to ensure compliance with mandatory building codes
60	60	and commission rules; and
61	61	(B) all foundation and other on-site
62	62	construction, to ensure compliance with approved designs, plans,
63	63	and specifications.
64	64	SECTION 4. Not later than September 1, 2012, the Texas
65	65	Industrialized Building Code Council shall complete the study
66	66	required by Section 1202.1551, Occupations Code, as added by this
67	67	Act.
68	68	SECTION 5. This Act takes effect September 1, 2011.
