77 relating to the approval of designs, plans, and specifications of
88 industrialized housing and buildings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1202.155, Occupations Code, is amended
1111 by adding Subsection (c) to read as follows:
1212 (c) Notwithstanding Subsections (a) and (b), the commission
1313 by rule may adopt another method of indicating that the designs,
1414 plans, and specifications of industrialized housing and buildings
1515 satisfy the requirements of Subsection (a)(1) and are approved in
1616 accordance with Subsection (a)(2) if the study conducted under
1717 Section 1202.1551 recommends the method.
1818 SECTION 2. Subchapter D, Chapter 1202, Occupations Code, is
1919 amended by adding Section 1202.1551 to read as follows:
2020 Sec. 1202.1551. STUDY CONCERNING APPROVAL OF DESIGNS,
2121 PLANS, AND SPECIFICATIONS. (a) The council shall conduct a study
2222 to:
2323 (1) evaluate the current method of indicating approval
2424 of designs, plans, and specifications of industrialized housing and
2525 buildings under Sections 1202.155(a) and (b); and
2626 (2) identify and evaluate methods of indicating
2727 approval of designs, plans, and specifications of industrialized
2828 housing and buildings that are alternatives to the method described
2929 by Subdivision (1).
3030 (b) The study may recommend for adoption by the commission
3131 an alternative method identified under Subsection (a)(2) if the
3232 council determines that the method would:
3333 (1) ensure that the designs, plans, and specifications
3434 of industrialized housing and buildings:
3535 (A) meet or exceed the code standards and
3636 requirements under council interpretations and instructions; and
3737 (B) are approved by the department or an approved
3838 design review agency; and
3939 (2) be more efficient and cost-effective for the
4040 department or approved design review agencies.
4141 (c) This section expires September 1, 2014.
4242 SECTION 3. Section 1202.252(a), Occupations Code, is
4343 amended to read as follows:
4444 (a) A municipality that regulates the on-site construction
4545 or installation of industrialized housing and buildings may:
4646 (1) require and review, for compliance with mandatory
4747 building codes, a complete set of designs, plans, and
4848 specifications approved by the council [bearing the council's stamp
4949 of approval] for each installation of industrialized housing or
5050 buildings in the municipality;
5151 (2) require that all applicable local permits and
5252 licenses be obtained before construction begins on a building site;
5353 (3) require, in accordance with commission rules, that
5454 all modules or modular components bear an approved decal or
5555 insignia indicating inspection by the department; and
5656 (4) establish procedures for the inspection of:
5757 (A) the erection and installation of
5858 industrialized housing or buildings to be located in the
5959 municipality, to ensure compliance with mandatory building codes
6060 and commission rules; and
6161 (B) all foundation and other on-site
6262 construction, to ensure compliance with approved designs, plans,
6363 and specifications.
6464 SECTION 4. Not later than September 1, 2012, the Texas
6565 Industrialized Building Code Council shall complete the study
6666 required by Section 1202.1551, Occupations Code, as added by this
6767 Act.
6868 SECTION 5. This Act takes effect September 1, 2011.
