99 AN ACT
1010 relating to examinations for hiring in certain municipal fire
1111 departments.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 143.025, Local Government Code, is
1414 amended by amending Subsection (b) and adding Subsection (l) to
1515 read as follows:
1616 (b) An eligibility list for a beginning position in the fire
1717 or police department may be created only as a result of a
1818 competitive examination held in the presence of each applicant for
1919 the position, except as provided by Subsections (d), [and] (e), and
2020 (l). The examination must be based on the person's general
2121 knowledge and aptitude and must inquire into the applicant's
2222 general education and mental ability. A person may not be appointed
2323 to the fire or police department except as a result of the
2424 examination.
2525 (l) In a municipality with a population of more than 1.3
2626 million and less than 2 million, an examination for a beginning
2727 position in the fire department may include testing instruments to
2828 be used in addition to the written examination in the establishment
2929 of the initial eligibility list.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2011.
