| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 143.025, Local Government Code, is |
|---|
| 14 | 14 | | amended by amending Subsection (b) and adding Subsection (l) to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (b) An eligibility list for a beginning position in the fire |
|---|
| 17 | 17 | | or police department may be created only as a result of a |
|---|
| 18 | 18 | | competitive examination held in the presence of each applicant for |
|---|
| 19 | 19 | | the position, except as provided by Subsections (d), [and] (e), and |
|---|
| 20 | 20 | | (l). The examination must be based on the person's general |
|---|
| 21 | 21 | | knowledge and aptitude and must inquire into the applicant's |
|---|
| 22 | 22 | | general education and mental ability. A person may not be appointed |
|---|
| 23 | 23 | | to the fire or police department except as a result of the |
|---|
| 24 | 24 | | examination. |
|---|
| 25 | 25 | | (l) In a municipality with a population of more than 1.3 |
|---|
| 26 | 26 | | million and less than 2 million, an examination for a beginning |
|---|
| 27 | 27 | | position in the fire department may include testing instruments to |
|---|
| 28 | 28 | | be used in addition to the written examination in the establishment |
|---|
| 29 | 29 | | of the initial eligibility list. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2011. |
