99 relating to the allocation of certain federal career and technical
1010 education funds.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 7.109(d), Education Code, is amended to
1313 read as follows:
1414 (d) The State Board for Career and Technology Education may
1515 allocate funds appropriated to the board by the legislature or
1616 federal funds received by the board under the Carl D. Perkins Career
1717 and Technical [Vocational] Education Act of 2006 (20 U.S.C. Section
1818 2301 et seq.) or other federal law to an institution or program
1919 approved by the State Board of Education, the Texas Higher
2020 Education Coordinating Board, or another state agency specified by
2121 law. At least 40 percent of any federal funds allocated by the
2222 State Board for Career and Technology Education under this
2323 subsection must be allocated to support career and technical
2424 education at the postsecondary or adult level.
2525 SECTION 2. The change in law made by this Act to Section
2626 7.109, Education Code, applies beginning with an allocation of
2727 federal funds made on or after the expiration of the Texas State
2828 Plan for Career and Technical Education, 2008-2013.
2929 SECTION 3. This Act takes effect September 1, 2011.
