| 12 | 12 | | registration; providing a penalty. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Sections 643.253(b) and (e), Transportation |
|---|
| 15 | 15 | | Code, are amended to read as follows: |
|---|
| 16 | 16 | | (b) A person commits an offense if the person engages in or |
|---|
| 17 | 17 | | solicits the transportation of household goods for compensation and |
|---|
| 18 | 18 | | is not registered as required by Subchapter B. |
|---|
| 19 | 19 | | (e) An offense under Subsection (b) is a Class C |
|---|
| 20 | 20 | | misdemeanor, except that the offense is: |
|---|
| 21 | 21 | | (1) a Class B misdemeanor if the person has previously |
|---|
| 22 | 22 | | been convicted one time of an offense under Subsection (b); and |
|---|
| 23 | 23 | | (2) a Class A misdemeanor if the person has previously |
|---|
| 24 | 24 | | been convicted two or more times of an offense under Subsection (b) |
|---|
| 25 | 25 | | [punishable by a fine of not less than $200 or more than $1,000 per |
|---|
| 26 | 26 | | violation]. |

| 27 | 27 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 28 | 28 | | to an offense committed on or after the effective date of this Act. |
|---|
| 29 | 29 | | An offense committed before the effective date of this Act is |
|---|
| 30 | 30 | | covered by the law in effect when the offense was committed, and the |
|---|
| 31 | 31 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 32 | 32 | | this section, an offense was committed before the effective date of |
|---|
| 33 | 33 | | this Act if any element of the offense occurred before that date. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2011. |
