99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the offense of transporting household goods without
1212 registration; providing a penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 643.253(b) and (e), Transportation
1515 Code, are amended to read as follows:
1616 (b) A person commits an offense if the person engages in or
1717 solicits the transportation of household goods for compensation and
1818 is not registered as required by Subchapter B.
1919 (e) An offense under Subsection (b) is a Class C
2020 misdemeanor, except that the offense is:
2121 (1) a Class B misdemeanor if the person has previously
2222 been convicted one time of an offense under Subsection (b); and
2323 (2) a Class A misdemeanor if the person has previously
2424 been convicted two or more times of an offense under Subsection (b)
2525 [punishable by a fine of not less than $200 or more than $1,000 per
2626 violation].
2727 SECTION 2. The change in law made by this Act applies only
2828 to an offense committed on or after the effective date of this Act.
2929 An offense committed before the effective date of this Act is
3030 covered by the law in effect when the offense was committed, and the
3131 former law is continued in effect for that purpose. For purposes of
3232 this section, an offense was committed before the effective date of
3333 this Act if any element of the offense occurred before that date.
3434 SECTION 3. This Act takes effect September 1, 2011.
