88 AN ACT
99 relating to the carrying of concealed handguns by county
1010 commissioners attending a meeting of the commissioners court.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.035, Penal Code, is amended by adding
1313 Subsection (l) to read as follows:
1414 (l) It is a defense to prosecution under Subsection (c) that
1515 at the time of the commission of the offense:
1616 (1) the actor was a county commissioner attending a
1717 meeting of the commissioners court;
1818 (2) the commissioners court previously adopted and has
1919 maintained in effect an order or rule authorizing a county
2020 commissioner to carry a concealed handgun that the person is
2121 licensed to carry under Subchapter H, Chapter 411, Government Code,
2222 at a meeting of the commissioners court; and
2323 (3) the handgun was concealed.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 covered by the law in effect when the offense was committed, and the
2828 former law is continued in effect for that purpose. For purposes of
2929 this section, an offense was committed before the effective date of
3030 this Act if any element of the offense occurred before that date.
3131 SECTION 3. This Act takes effect September 1, 2011.
