| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 46.035, Penal Code, is amended by adding |
|---|
| 13 | 13 | | Subsection (l) to read as follows: |
|---|
| 14 | 14 | | (l) It is a defense to prosecution under Subsection (c) that |
|---|
| 15 | 15 | | at the time of the commission of the offense: |
|---|
| 16 | 16 | | (1) the actor was a county commissioner attending a |
|---|
| 17 | 17 | | meeting of the commissioners court; |
|---|
| 18 | 18 | | (2) the commissioners court previously adopted and has |
|---|
| 19 | 19 | | maintained in effect an order or rule authorizing a county |
|---|
| 20 | 20 | | commissioner to carry a concealed handgun that the person is |
|---|
| 21 | 21 | | licensed to carry under Subchapter H, Chapter 411, Government Code, |
|---|
| 22 | 22 | | at a meeting of the commissioners court; and |
|---|
| 23 | 23 | | (3) the handgun was concealed. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to an offense committed on or after the effective date of this Act. |
|---|
| 26 | 26 | | An offense committed before the effective date of this Act is |
|---|
| 27 | 27 | | covered by the law in effect when the offense was committed, and the |
|---|
| 28 | 28 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 29 | 29 | | this section, an offense was committed before the effective date of |
|---|
| 30 | 30 | | this Act if any element of the offense occurred before that date. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2011. |
