99 AN ACT
1010 relating to the authority of certain counties to appoint, contract
1111 for, or employ physicians, dentists, or other health care providers
1212 for county jails.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter C, Chapter 351, Local Government
1515 Code, is amended by adding Section 351.045 to read as follows:
1616 Sec. 351.045. EMPLOYMENT OF HEALTH CARE PROVIDERS IN
1717 CERTAIN COUNTIES. (a) The commissioners court of a county with a
1818 population of 3.3 million or more may appoint, contract for, or
1919 employ licensed physicians, dentists, or other health care
2020 providers to provide health care services to inmates in the custody
2121 of the sheriff.
2222 (b) This section may not be construed as authorizing a
2323 commissioners court to supervise or control the practice of
2424 medicine as prohibited by Subtitle B, Title 3, Occupations Code, or
2525 to supervise or control the practice of dentistry as prohibited by
2626 Subtitle D, Title 3, Occupations Code.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2011.
