66 AN ACT
77 relating to certain eligibility requirements of the Teach for Texas
88 Loan Repayment Assistance Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 56.353, Education Code, is amended by
1111 amending Subsections (a) and (b) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) Teach for Texas repayment assistance is available only
1414 to a person who applies for the assistance and who:
1515 (1) is certified in a teaching field identified by the
1616 commissioner of education as experiencing a critical shortage of
1717 teachers in this state in the year in which the person receives the
1818 assistance and has for at least one year taught full-time at, and is
1919 currently teaching full-time at, the preschool, primary, or
2020 secondary level in a public school in this state in that teaching
2121 field; [or]
2222 (2) is a certified educator who has for at least one
2323 year taught full-time at, and is currently teaching full-time at,
2424 the preschool, primary, or secondary level in a public school in
2525 this state at which it is difficult to attract or retain educators,
2626 as [in a community] identified by the commissioner of education for
2727 [as experiencing a critical shortage of teachers in] the year in
2828 which the person receives the assistance; or
2929 (3) is a certified educator who has for at least one
3030 year taught full-time at, and is currently teaching full-time at,
3131 the preschool, primary, or secondary level in a public school in
3232 this state in which more than 50 percent of the students enrolled
3333 are economically disadvantaged, as identified by the commissioner
3434 of education for the year in which the person receives the
3535 assistance.
3636 (a-1) The commissioner of education each year shall
3737 identify:
3838 (1) for purposes of Subsections (a)(2) and (3), public
3939 schools in this state at which it is difficult to attract or retain
4040 educators; and
4141 (2) for purposes of Subsection (a)(3), public schools
4242 in this state in which more than 50 percent of the students enrolled
4343 are economically disadvantaged.
4444 (b) The coordinating board in awarding repayment assistance
4545 shall give priority to applicants who are described by Subsection
4646 (a)(2) or (3) or who demonstrate financial need.
4747 SECTION 2. The change in law made by this Act to Section
4848 56.353, Education Code, applies only to eligibility for loan
4949 repayment assistance under Subchapter O, Chapter 56, Education
5050 Code, on the basis of an application submitted on or after September
5151 1, 2011. Eligibility on the basis of an application submitted
5252 before September 1, 2011, is covered by the law in effect at the
5353 time the application was submitted, and the former law is continued
5454 in effect for that purpose.
5555 SECTION 3. This Act takes effect September 1, 2011.
