10	10	relating to certain financial requirements of certain toll project
11	11	entities.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter B, Chapter 372, Transportation Code,
14	14	is amended by adding Sections 372.054 and 372.055 to read as
15	15	follows:
16	16	Sec. 372.054. ANNUAL AUDIT. (a) In this section, "toll
17	17	project entity" does not include the department.
18	18	(b) A toll project entity shall have an annual audit of the
19	19	affairs of the toll project entity prepared by an independent
20	20	certified public accountant or a firm of independent certified
21	21	public accountants.
22	22	Sec. 372.055. ELECTRONIC CHECKING ACCOUNT TRANSACTION
23	23	REGISTER. (a) In this section, "toll project entity" does not
24	24	include the department.
25	25	(b) Except as provided by Subsection (f), a toll project
26	26	entity shall designate a person to maintain an electronic checking
27	27	account transaction register for the entity's checking account.
28	28	The register must:
29	29	(1) be in a searchable, electronic spreadsheet format;
30	30	and
31	31	(2) be available without a fee for viewing and
32	32	downloading by the public at all times on the entity's Internet
33	33	website.
34	34	(c) The electronic checking account transaction register
35	35	must include for each expense transaction from the toll project
36	36	entity's account:
37	37	(1) the transaction amount;
38	38	(2) the name of the payee; and
39	39	(3) a statement describing the purpose of the
40	40	expenditure.
41	41	(d) A toll project entity may not include in the entity's
42	42	electronic checking account transaction register a check issued to
43	43	an entity employee in payment of salary, wages, or an employment
44	44	stipend.
45	45	(e) A toll project entity shall:
46	46	(1) update the electronic checking account
47	47	transaction register at least once each month, not later than the
48	48	30th day after the closing date of the most recent monthly statement
49	49	for the checking account; and
50	50	(2) maintain each transaction or listing in the
51	51	electronic checking account transaction register on the entity's
52	52	Internet website until the first anniversary of the date of the
53	53	transaction or listing.
54	54	(f) The person designated to maintain the electronic
55	55	checking account transaction register under Subsection (b) may
56	56	consult with the comptroller in developing the register.
57	57	SECTION 2. A toll project entity required to maintain an
58	58	electronic checking account transaction register under Section
59	59	372.055, Transportation Code, as added by this Act, shall make the
60	60	register available for public viewing or downloading not later than
61	61	January 1, 2012. The register must contain the information
62	62	required by Section 372.055(c), Transportation Code, as added by
63	63	this Act, with regard to each transaction occurring on or after the
64	64	effective date of this Act.
65	65	SECTION 3. This Act takes effect September 1, 2011.
