88 AN ACT
99 relating to the purchase of plastic bulk merchandise containers by
1010 certain businesses; providing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 204.002, Business & Commerce Code, is
1313 amended by amending Subsections (a) and (c) and adding Subsections
1414 (d), (e), and (f) to read as follows:
1515 (a) A person who is in the business of recycling, shredding,
1616 or destroying plastic bulk merchandise containers, before
1717 purchasing five or more plastic bulk merchandise containers from
1818 the same person, shall:
1919 (1) obtain from that person:
2020 (A) proof of ownership for the containers; and
2121 (B) a record that contains:
2222 (i) the name, address, and telephone number
2323 of the person or the person's authorized representative;
2424 (ii) the name and address of the buyer of
2525 the containers or any consignee of the containers;
2626 (iii) a description of the containers,
2727 including the number of the containers to be sold; and
2828 (iv) the date of the transaction; and
2929 (2) verify:
3030 (A) the identity of the individual selling the
3131 containers or representing the seller from a driver's license or
3232 other government-issued identification card that includes the
3333 individual's photograph, and record the verification; or
3434 (B) in a manner determined by the purchaser that
3535 the individual is acting on behalf of a corporation, business,
3636 government, or governmental subdivision or agency.
3737 (c) A person who is in the business of recycling, shredding,
3838 or destroying plastic bulk merchandise containers and who purchases
3939 a plastic bulk merchandise container from an individual, unless the
4040 person verifies in a manner determined by the purchaser that the
4141 individual is acting on behalf of a corporation, business,
4242 government, or governmental subdivision or agency:
4343 (1) may not pay for the purchase of any plastic bulk
4444 merchandise container with cash; and
4545 (2) shall, for each transaction in which the person
4646 purchases one or more plastic bulk merchandise containers, record
4747 the method of payment used to purchase the containers.
4848 (d) A record made under Subsection (c)(2) shall be attached
4949 to a record made or obtained under Subsection (a) if a record is
5050 required under that subsection.
5151 (e) A person who violates Subsection (a) or (b) is liable to
5252 this state for a civil penalty of $10,000 for each violation.
5353 (f) A person who violates Subsection (c) is liable to this
5454 state for a civil penalty in an amount not to exceed $10,000 for
5555 each violation. Each cash transaction made in violation of
5656 Subsection (c)(1) is a separate violation for purposes of imposing
5757 a penalty under this subsection. In determining the amount of the
5858 civil penalty imposed under this subsection, the court shall
5959 consider the amount necessary to deter future violations.
6060 SECTION 2. Section 204.004(a), Business & Commerce Code, is
6161 amended to read as follows:
6262 (a) The attorney general or appropriate prosecuting
6363 attorney may:
6464 (1) inspect a record retained by a person under
6565 Section 204.002;
6666 (2) investigate an alleged violation of this chapter;
6767 and
6868 (3) [(2)] sue to collect a civil penalty under this
6969 chapter.
7070 SECTION 3. This Act takes effect September 1, 2011.
