99 AN ACT
1010 relating to prohibiting school districts from requiring or coercing
1111 school district employees to make charitable contributions.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 22, Education Code, is
1414 amended by adding Section 22.011 to read as follows:
1515 Sec. 22.011. REQUIRING OR COERCING EMPLOYEES TO MAKE
1616 CHARITABLE CONTRIBUTIONS. (a) A school district board of trustees
1717 or school district employee may not directly or indirectly require
1818 or coerce any school district employee to:
1919 (1) make a contribution to a charitable organization
2020 or in response to a fund-raiser; or
2121 (2) attend a meeting called for the purpose of
2222 soliciting charitable contributions.
2323 (b) A school district board of trustees or school district
2424 employee may not directly or indirectly require or coerce any
2525 school district employee to refrain from:
2626 (1) making a contribution to a charitable organization
2727 or in response to a fund-raiser; or
2828 (2) attending a meeting called for the purpose of
2929 soliciting charitable contributions.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2011.
