| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 43.002, Local Government Code, is | |
| 11 | 11 | amended by adding Subsection (e) to read as follows: | |
| 12 | 12 | (e) A regulation relating to the sale and use of fireworks | |
| 13 | 13 | is subject to the restrictions in Section 43.133. | |
| 14 | 14 | SECTION 2. Subchapter F, Chapter 43, Local Government Code, | |
| 15 | 15 | is amended by adding Section 43.133 to read as follows: | |
| 16 | 16 | Sec. 43.133. SALE OR USE OF FIREWORKS IN ANNEXED AREA. A | |
| 17 | 17 | municipality that annexes an area for limited purposes under this | |
| 18 | 18 | subchapter may not prohibit the sale or use of fireworks in the | |
| 19 | 19 | area. | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2011. |
