| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.023(c-3), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (c-3) In adopting a schedule for the administration of |
|---|
| 13 | 13 | | assessment instruments under this section, the State Board of |
|---|
| 14 | 14 | | Education shall require: |
|---|
| 15 | 15 | | (1) assessment instruments [administered] under |
|---|
| 16 | 16 | | Subsection (a) to be administered on a schedule so that the first |
|---|
| 17 | 17 | | assessment instrument is administered at least two weeks later than |
|---|
| 18 | 18 | | the date on which the first assessment instrument was administered |
|---|
| 19 | 19 | | under Subsection (a) during the 2006-2007 school year; [and] |
|---|
| 20 | 20 | | (2) the spring administration of end-of-course |
|---|
| 21 | 21 | | assessment instruments under Subsection (c) to occur in each school |
|---|
| 22 | 22 | | district not earlier than the first full week in May, except that |
|---|
| 23 | 23 | | the spring administration of the end-of-course assessment |
|---|
| 24 | 24 | | instruments in English I, English II, and English III must be |
|---|
| 25 | 25 | | permitted to occur at an earlier date; and |
|---|
| 26 | 26 | | (3) the administration of assessment instruments |
|---|
| 27 | 27 | | under Subsection (a) and end-of-course assessment instruments |
|---|
| 28 | 28 | | under Subsection (c) to be administered as provided by this |
|---|
| 29 | 29 | | subsection on a date other than a uniform election date under |
|---|
| 30 | 30 | | Section 41.001, Election Code. |
|---|
| 31 | 31 | | SECTION 2. This Act applies beginning with the 2011-2012 |
|---|
| 32 | 32 | | school year. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2011. |
