66 AN ACT
77 relating to the schedule for administration of state-administered
88 assessment instruments in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023(c-3), Education Code, is amended
1111 to read as follows:
1212 (c-3) In adopting a schedule for the administration of
1313 assessment instruments under this section, the State Board of
1414 Education shall require:
1515 (1) assessment instruments [administered] under
1616 Subsection (a) to be administered on a schedule so that the first
1717 assessment instrument is administered at least two weeks later than
1818 the date on which the first assessment instrument was administered
1919 under Subsection (a) during the 2006-2007 school year; [and]
2020 (2) the spring administration of end-of-course
2121 assessment instruments under Subsection (c) to occur in each school
2222 district not earlier than the first full week in May, except that
2323 the spring administration of the end-of-course assessment
2424 instruments in English I, English II, and English III must be
2525 permitted to occur at an earlier date; and
2626 (3) the administration of assessment instruments
2727 under Subsection (a) and end-of-course assessment instruments
2828 under Subsection (c) to be administered as provided by this
2929 subsection on a date other than a uniform election date under
3030 Section 41.001, Election Code.
3131 SECTION 2. This Act applies beginning with the 2011-2012
3232 school year.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
