 A BILL TO BE ENTITLED
 AN ACT
 relating to providing a parent of a public school student with
 notice of student performance in the parent's native language.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 28.022(b), Education Code, is amended to
 read as follows:
 (b)  The notice required under Subsections (a)(2) and (a)(3)
 must:
 (1)  provide for the signature of a student's parent;
 [and]
 (2)  be returned to the district; and
 (3)  if the student is a student of limited English
 proficiency, as defined by Section 29.052, or a student who
 receives special education services under Subchapter A, Chapter 29,
 be written in the parent's or guardian's native language.
 SECTION 2.  This Act applies beginning with the 2011-2012
 school year.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
